Gabriel Cuen-Butimea, 48, was shot on Monday January 30th by 73-year-old rancher George Alan Kelly, after crossing onto Kelly's land in Kino Springs, a remote area of Arizona just 1.5miles from the border.

He was unarmed and was shot once - dying on the property.

Kelly, who friends say has had trouble with other migrants passing through his land, remains in custody in Arizona on a $1million bond, awaiting his next court appearance on a single murder charge.

Cuen-Butimea tried multiple times to enter the US illegally before Kelly shot him dead.

Records indicate he was deported several times, most recently in 2016.

It's unclear if he ever crossed the border onto Kelly's property before the incident on Monday.

Sheriffs say they did not know each other.

Many of the details of the case remain unclear, including whether Kelly will be able to invoke a stand your ground defense.

As Kelly awaits his next court appearance, Cuen-Butimea's family in Mexico are mourning his death and demanding justice.

'We will get justice for you, daddy, I promise,' his adult daughter said alongside Kelly's mugshot.

The family has not explained why Cuen-Butimea had crossed over into Kelly's land.

In court yesterday, Kelly begged to have his $1milion bond lowered.

'She's there by herself... nobody to take care of her, the livestock or the ranch.

'And I'm not going anywhere. I can't come up with a million dollars.

'Would you consider reducing it to any degree?' he said.

The judge, Justice of the Peace Emilio Velasquez, told him his lawyer would have to file a request to lower bond.

Kelly was appointed local public defender Brenna Larkin, who is yet to answer any media inquiry about the case.

Arizona's Stand Your Ground laws​


Under Arizona law, 'a person is justified in threatening or using physical force against another when, and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against the other's use or attempted use of unlawful physical force.'
It could be used as a defense when homeowners attack — or potentially even kill — someone to stop certain crimes like murder, rape or armed robbery.
The Stand Your Ground laws are not permitted as a defense, however, when there was only a verbal provocation or the homeowner who is claiming self-defense provoked the attack.
By using the Stand Your Ground laws as a defense, prosecutors have to prove beyond a reasonable doubt that a defendant was not justified in using deadly force in self-defense.

This is all pure speculation since no information has come out to confirm or deny this, but it seems like this was indeed the case. Coming from those that have been present in the courtroom, it seemed that one of the female jurors had been visibly crying out of frustration during the deliberation. This same juror had reacted emotionally to the testimony specifically regarding the illegal alien who was shot and died. Most likely holding onto a guilty vote for purely ideological reasons instead of applying the reasonable doubt standard.

There is additional speculation that the total vote was leaning in favor of not guilty, with the tally being accidentally revealed to the judge after the first indication of a deadlocked jury. This was further hinted at because several of the jurors appeared to be frustrated with what is believed to be the crying female juror.

Again, this is all bullshit I’ve gleaned from watching a few livestreams and could be completely wrong.

Yeah, chalk up another one for emotional women being society's greatest threats here. Honestly, the DA couldn't even find a bullet or link the dead man to Kelly beyond being on his property. They couldn't show if he was shot by a rifle, a pistol, or a high velocity slingshot. Zero grounds to convict, period.

I really hope the DA cocksucker takes the L and refuses to go to trial again.

For those interested, there was a hung jury in this case, i.e. a mistrial. The State presented a shit case, couldn’t even locate the fatal bullet and one of the “witnesses” is a known cartel drug runner. The state will decide if it wants to retry the case in a few days.

State prosecutors said Monday they will not seek to retry 75-year-old George Alan Kelly, the Arizona rancher accused of fatally shooting an unarmed migrant on his property near the U.S.-Mexico border.

“Because of the unque circumstances and challenges surrounding this case, the Santa County Attorney’s office has decided not to seek a retrial,” said Deputy County Attorney Kimberly Hunley at a status hearing.

As prosecutors made their announcement, Kelly could be seen hanging his head and appeared to be overcome with emotion.

Another hearing will be set to consider the defense’s request to dismiss the case with prejudice.

Last Monday, a judge declared a mistrial in the case after jurors were unable to reach consensus about whether to charge Kelly with second-degree murder and aggravated assault. He had pleaded not guilty.

Kelly was accused of shooting his AK-47 from a far distance at a group of migrants who were headed back across the border into Mexico. Prosecutors said Gabriel Cuen-Buitimea, 48, a migrant who lived just across the border in Nogales, Mexico, and was looking for work, was fatally struck. Law enforcement officials were never able to recover the bullet, and Kelly’s lawyers tried to make the point that another person may have shot him. No other weapon was discovered in the area.
 
Unfortunately, I feel like convicted or not he may be ruined. When they were first arresting him I remember he had pleaded for some sort of achievable bail because his wife was elderly and frail and couldn't handle the farm and livestock by herself. I hope she was able to call in family to keep things afloat without her husband there for a couple of months.

Yea, they couldn’t even find the lethal bullet so there’s no way to do proper ballistics, not that those are generally worth a damn in these kinds of situations. Also, from my understanding of the evidence, the trajectory of the bullet through the victim was nearly physically impossible to achieve with the way Kelly was firing his weapon into the air, unless he’s able to do some Wanted level bullet curving/ricochet techniques.
