Wow. They really made a game based on those old Flash ads where you punched Bush or Osama.

Why did they make all the characters Canadian?
It's easier to animate, either that or they could claim it's a nod to DSP's portrayal in the old YouTube machinima series called "YouTube Avenue" created by GMod idiot box guy, DasBoSchitt
 
It's kind of stupid that they didn't do a parody with his face and voice; this has opened them up to a lawsuit or store removal for sure. Let's hope they don't use Rekieta as a lawyer. If anything else, I'm going to buy this one to archive in my collection.

But they should have made it free in the first place, would be way more funny
 
Looks cute, but are they allowed to use his likeness while making money off it? I mean arguably his likeness is the whole selling point.
As other anons have said they should have made the game free and this immune to any problems like that. On the other hand they know DSP will never pony up the money for a lawyer or go through the hassle of legal shit. So its just another way to rub his gouty face in how hated he is.

I guess Phil could sue em pro se like Greer. Probably would allege defamation even though it's obvious parody. It's basically the same deal as South Park using Saddam's Hussein as a character. He's in Washington, could drive over to Valve even. Won't happen but it would be funny.

Anyway this is amazing and Phil wishes his fans were this talented. I bet one of em will make a crappy RPGmaker game in response to this.

It is much more likely than not: Yes unauthorized use of likeness is actionable, and the fact that the devs are charging money could be used to justify monetary damages. On the other hand, Washington specifically exempts parody and satire from its unauthorized use of likeness statute:
Revised Code of Washington (RCW) 63.60.070 said:
(1) For purposes of RCW 63.60.050, the use of a name, voice, signature, photograph, or likeness in connection with matters of cultural, historical, political, religious, educational, newsworthy, or public interest, including, without limitation, comment, criticism, satire, and parody relating thereto, shall not constitute a use for which consent is required under this chapter. A matter exempt from consent under this subsection does not lose such exempt status because it appears in the form of a paid advertisement if it is clear that the principal purpose of the advertisement is to comment on such matter.

Do I think this game is clearly parodic? Yeah absolutely. Do I think that defense is airtight enough to avoid a long, expensive trial? No and that's why I would not have done what the devs did. DSP isn't going to sue because that's money he could spend on gacha but I'm not going to take that risk.

Phil is too lazy to do that and we all know it. If I'm wrong and lolsuit Christmas comes early, Washington's anti-SLAPP law would let whoever he sued file a counterclaim for dismissal and attorneys' fees. He may not have the money to pay opposing counsel..... which is about where they'd slap a lien on the Snort Fort.

They should have done the donation route of "Game is free but help us fund more games in the future *Wink Wink*". I think that would go way better but probably be less money overall.

Nothing at all. That doesn't stop Phil from filing a frivolous defamation claim and forcing the defendants to spend thousands in legal fees to get it thrown out.

If this sounds like an easily abusable system welcome to Null's world - between Melinda Scott and Russell Greer defending against vexatious pro se litigants has probably cost him tens of thousands of dollars. The main saving grace here is that Phil is too goddamn stupid to understand how the legal system works, much less how to abuse it.
