No photos of him, none of his content, and most importantly Kyle wouldn't complain. More likely leftards have already complained the game incites real-life violence or something (and got ignored).

If I made a game that's me shitting on nintendo by using mario as the protagonist and pull a PETA shit where I just make mario shart on tanukis and have the tanukis say "NINTENDO" on it, and slapped a 4.99$ price tag, it's no longer a parody.
I'm no lolyer but if people continue being retards, I gotta try to assplain.

A parody ridicules the work it draws on. A parody of Mario should make fun of a Mario game. Not Nintendo as a corporation. Not DRUMPH. Not anything else. "Scat porn of Mario" is not parody, it's copyright/trademark infringement that hurts the value of the brand even more than a typical infringement does. Bonus points for poasting "I made a game shitting on Nintendo because I hate Nintendo". Even if you drew your own Mario sprites and garbled the Nintendo name, "distinctive likeness" and "reasonable consumer" have this covered. (But a bearded Greek welder shitting on a completely different corporation would be "ok".)

The DSP game is a parody of the DSP stream. In a theoretical court battle, the developers could win. However:
  • Steam isn't particularly eager to get into DSP lore to find out if it's a parody or not, DSP's arguments are stronger if he says, "this has nothing to do with me EXCEPT it uses my actual face FOR NO REASON" rather than "it's clearly about me, it features every incident when I've been a lolcow"
How could a lolsuit come about?
  • DSP could sue for infringement (and lose) -- unlikely, he's lazy and broke and already got what he wanted.
  • The developer could sue for interference or something -- much harder to win. Steam decides what they do and do not host, they made the decision to take down a game when they were informed of a true fact. If you could sue Steam into accepting your game, this would have massive consequences for every platform (including Apple).
 
I'm not really feeling sorry for the devs here, using his likeness and charging money for it was asking for trouble, game should have been free and they would have avoided this whole thing.

There's something so deliciously spiteful about blatantly using someone's likeness to absolutely dunk on them, especially with something as labor-intensive as a fully functional video game.

It wouldn't nearly carry the same sting if the studio played coy with a parody from the get-go.

Charging money for the game is just an extra layer to the satire–Phil resents anyone who not only makes fun of him, but makes any modicum of money off of his ineptitude.

It's not even the amount of money that upsets him, but the principle. And the principle was made loud-and-clear.

Id like to imagine with a few, minor, changes, the game will be back. Phil's clearly bothered by its existence, the studio makes a modest sum, and we all get to laugh.
 
So if the developer just alters the game slightly by removing Phil's head and use some of the detractor art that uses a pig's head (the ultimate art would be to combine it with a nazi hat) then they would be in the clear. After all that would not be the real Phil just a parody version
 
Every chance he ever gets to lean into the joke and maybe flip it into something beneficial (eg TIHYDP movement) he fails miserably. Forever stuck on mission 1 like the retarded thin-skinned faggot he is.
In 10 years, when he will be in an even shittier place, he will say he regret not embracing this as a joke, just like he did with tihydp videos. Rince and repeat cause dsp, dsp never changes.

Not to mention the dev could easily upload an uncensor patch somewhere else for that full Pigroach experience.

As such, I would imagine that this makes it a parody of a character.

Phil is right to DMCA takedown blatant raw restreams or uploads of his streams. No matter the mental gymnastics or analogies you want to resort to, they are not fair use and he's 100% allowed to take them down.

This guy made an asset flip of a game, put his face on it and is selling it at $5.00. It is objectively using his likeness, it is objectively without permission, and it is not in fair use.

Phil is, and will always be a fucked bitch and a salty subhuman scum fuck, and I will always find enjoyment in his misery, but he is LEGALLY in the right to take shit like this down. It's just a really bad look for him (or his "team", and it makes him look even more like a bitch.

It was more than likely one of his dents operating on his behalf. It takes Phil several hours to fix a YouTube video thumbnail, there's no way he could be bothered to actually write something up to have it handled this quickly.

Agreed that this specifically is what was its own undoing. It could have been very easily avoided if it were done with artwork instead. The pricetag just did it in faster IMO.

Shit like this really should just be a free download off itch.io or something. Dumb asset flips can be fun (I still have DORNER NEVER LIED.wad lying around somewhere), but commercializing it is just gay.

Alternatively you could argue that putting the character into the game is illicitly using Phil's IP without permission to make money, and since both entities are video gaming related there's potentially a legitimate argument here.

Its not an asset flip. Asset flip would be stealing character models wholesale off of an unreal library.

phil didn't make the actual sprites in the game. He didn't really even make the jpegs of his iconic moments that they are partially composed of. Its the detractors that selected them and clipped them out in photoshop and then posted them and made them into memes.

If Phil had his way these jpegs would just be components of random frames in his thousands of hours of garbage video with no meme history or anything special about them whatsoever.

Theres several levels of transformations from his raw video to these sprites. Far more than the 'transformation' he performs on the games he plays.

If what you're saying is true every single video containing any element of an image or video from him or anybody else regardless of how much its been edited can be struck down at their leisure.

I have not seen a single picture of phil in the game that has not been altered in some significant way. Be it directly or being placed within an original background and animated. Also all the sounds have been altered as well.

Unlike David I don't see any issues with paying creatives. And given how long ago I first saw the trailer for this game, he clearly put in a lot of hours. I don't see why he shouldn't charge money, especially just $5 like come on bro thats pocket change.


If your point is to say that the game wouldn't have been taken down if it was free, I don't see how that would make any difference. Superhound would just send the same bullshit email from "AK, Renton" and the game would get shoah'd again. The money doesn't make a difference here, the insane schizo writing emails is going to write emails regardless.
