No you can’t legally. Same reason you can’t yell bomb in a crowd or start yelling murder on an airplane.

That article was ‘actually-ing’ a surpreme court justice who was repeating that you can’t just yell inflammatory (no pun) statements that can lead to injury. First Amendment protections aren’t unlimited.

In terms of his case, the federal sentencing guidelines are going to fuck him. His rap sheet will be taken in consideration of his sentence. It’s also one of the reasons the AUSA took the case.

The weens will be fucked if directly told him to commit illegal acts. I don’t see them doing any time, unless did some seriously illegal shit, but I do think their names might come out if adults. Though their was a case where someone got sentenced for telling another adult to commit suicide — and they did

The case you're talking about with suicide the girl had him on the phone and set there telling him to do it for like 20-30 minutes while he tried to explain why he shouldn't... it wasn't just "go kill yourself faggot, lol"

First, that was never binding precedent, it was obiter dicta, that is, "other words," not the ratio decidendi or the reason for the decision. More importantly, though, other than quibbling about legalities, Oliver Wendell Holmes, Jr., publicly regretted this statement and it was one of the greatest regrets of his career. It was a stupid thing to say, it is too bad a very smart person said something so stupid, and despite him publicly regretting saying something this dumb, it still pollutes the atmosphere.

Well sure, any "illegal" action is legal if you don't actually have the intent (or ability) to commit the actual criminal matter involved.

The entire point is that Constitutional freedoms have a limit as a defense when it involves commission of a crime, his mistake was not making that clear and leaving it vague and open to interpretation. Which is a bad thing to do if you are a chief justice of a common law legal system where the interpretation of the law can change more easily over time.

It is always illegal to yell "fire" in a crowded theater if, given the circumstances, a reasonable person would believe there is a fire and there is evidence of criminal intent behind it. Because the crime involved isn't the statement itself, it's the intent to induce panic by doing so.

I agree that somebody encouraged him to make those threats or at least triggered him to doing it, but Daniel has made statements before about wanting to have a sex change operation and admitted to cross dressing, the only reason why Danderson never transition is because his father is transphobic and threatened to disown him.
Even if Daniel did decide to transition he wouldn’t be able to because he has poor spending habits and because he’s too retarded to figure out how to transition.

Despite daniel being a reprobate or whatever, there's always a chance he can improve. If he goes to jail, there's close to no chance of improvement within or outside of those walls.
If the trolls keep fucking with him, same thing.
If he gets good housing housing and job, same thing.
There's a lot that would need to change for daniel to ever be a somewhat normal member of society. And I don't think he wants it to change.
