Nick lost his appeal.

Nick can't see this as a loss. He needs to appeal to the state supreme court next. Then take it up the federal courts all the way to the US Supreme Court.

It was just one bad judge. Nick needs to just keep doubling down until he inevitably wins. I mean its Nick. Nick doesn't lose.

I also think the ruling went against him because the judge thinks he is fat. He really needs to shed some more of those excess pounds.

Correct, but since the judge in the case already said what Nick said was defamation per se, a trial doesn't look good for Nick.

Yup! The big reason this was an L was how much money Nick has likely thrown away (to Randazza) to pursue an esoteric (and now twice losing) legal strategy. Also, the usual Rekieta L's of ego, narcissism, ODD, etc.

The only way I could see him settle is if money is starting to get tight for him. But the more likely option would be for him to switch to more cost-effective representation than Randazza.

At this point, its a rather straightforward case and Randazza doesn't add anything to it other than very high costs.

I think this guy is such a retard that if it really came down to it, he will actually take out a loan for this before ever settling or admitting he was wrong. Put up some expensive shit as collateral if he has to. What lender would ever cooperate? Oh he'll find someone.

Anything is better than admitting he was wrong about anything. Even if it costs him everything.

Losing this appeal means that Nick will not be able to attempt anti-SLAPP in the case and the case will not be done according to Colorado law. I don't know that Colorado law (other than anti-SLAPP) would have done much. Using Colorado law in a Minnesota court would have made the case more complex and more expensive for everyone involved. But otherwise I don't think it matters much.

But even if he won the appeal, I think he would have lost an anti-SLAPP decision anyway. As a technical matter of law, the appeal mattered more much to Randazza's personal law nerd interests than it did to Nick's case.

He hasn’t lost, but his statements have already been ruled defamation per se. The appeal was trying to apply Colorado Anti-SLAPP because Montegraph was a Colorado resident.

Minnesota law is worse for Nick, who basically wanted the appeal to win and then get a summary judgement. Nick also poisoned his name in his local law community by sounding like a cunt at many occasions. Montegraph’s lawyer is someone who Nick has beef with. The judge who ruled defamation per se had a shower call elevator cornering with Nick before.

You really just need to show clips of Nick’s original defamatory remark, then him tripling down, and then how he’d never settle. Nick called a man a child molester and has since said he produces CSAM/ CP.

If I hadn’t been drunk that night and formulated it as: “I think that Monte looks like a pedo!” There wouldn’t have been a case.

If he hadn’t been drunk in the following days and made a half hearted retraction about how this show is all laughs and rants and no, he doesn’t have any knowledge that Monty is a pedo, there wouldn’t have been a case.
