I've heard alcohol tests are notoriously relaxed and easy to fool, but I'm no expert. I think the window is 72 hours, but it can be lowered all the way to 24 if you know what you're doing.
Ironically, that may be what makes Rekieta fail, should he not sober up. He'll overestimate how much he can drink, thinking he can flush it from his system in time for a test.

He's on pretrial release for felony charge so it'll be stricter than regular probation or a misdemeanor. but they won't have the time or resources for anything real. These are government employees after all. If it was serious enough of a charge they'd hold without bond.

The search warrant seems to be his only viable angle to beat this, thanks to the US being the only country on Earth where illegally obtained evidence is inadmissible at trial. How would the cops have established probable cause such that a judge signed off on a warrant to search the house for drugs?

We know the police received a child abuse/neglect report from the pastor a week ago. My guess is the pastor said "the Rekietas have 5 kids in the house and I observed them acting and looking all fucked up like they're on drugs." He has firsthand knowledge of Nick being wasted but, presumably, hasn't actually seen any drug use and has no idea whether there's drugs in the house.

So the police spend the next week investigating?

If the cops don't have firsthand knowledge ("I observed Mr Rekieta nude, with a strange contraption attached to his testicles, snorting lines of a white powder that, based on my training and experience, was cocaine."), they need reliable hearsay in the warrant affidavit. ("I talked to x who provided firsthand knowledge of having seen x drugs in Rekieta's possession, located in x location on recent date, and it's likely x drugs are currently located in x location. This person appears credible because x.")

Who provided this information?
If there's no informant, how could they have gotten the info needed for the warrant?

Kandiyohi County doesn't deal with this kind of shit very often. It's small, rural, white, and doesn't have any trafficking highways going through it. If they fucked up the warrant and the case gets tossed, it will be hilarious because the damage is already done. Total alog vindication already achieved. Nick would be seething and unchained.

On a sidenote, if a CPS case has been opened, we won't have any record of it, and I'd be shocked if a case weren't opened. With those cases, there's no "tee hee we got probation or off on a technicality." They're more like "admit you're a repugnant piece of shit, jump through 1 million retarded hoops, and you'll get full custody back in 12-18 months... otherwise we'll terminate your parental rights." It will be an absolute nightmare for Mr ODD smartest guy in the room who can do no wrong.

Tbh, though, I suspect that won't be of much relevance for a court and what would ever be factored in to "is this guy a decent human" is not going to include quote-unquote "shock jock" showmanship (riiiiight...), but they'd look more at "lawyer in good standing, husband and father of 5, no criminal history, church-goer, former Chamber of Commerce member, pays taxes [I assume], good kids, propping up the local snack food purveyors ;), supportive family, etc. And in rural MN, gun ownership and property rights are appreciated (by the general population), not considered a negative or sketch if you're otherwise standard society. Empathy toward addiction is also a strain in the courts.

It's meant to be an anonymous tip and we can't get the whole thing. It seems too good to be fake, but can't be verified. Can't remember who posted it, but it was someone who's name I recognized on Twitter, but didn't trust as a source without anything backing it up. Dive back through the big thread if you care.

It's been speculated before that Nick has a trust fund from the grandparents in his children's name or something, which is why he puts up with them. I'm sure someone else can articulate it better than I can. It's been pretty clear from his behavior that Nick does not seem to like being a father very much, so naturally that lead to the theory that there must be some sort of financial incentive, or it was for the sake of Kayla's familial ties or something. Which makes it all the more heinous that Nick's such a failure of a husband he's allowed his wife to enter the lifestyle of a crackwhore. Regardless of how culpable Kayla is in her own downfall, Nick's in-laws will probably look to blame him first. And I doubt he'd be off the hook for child support if his parental rights are terminated.

I could see Aaron testifying under the guise of 'protecting his ex-wife and Kayla'. He just has to get them away from that monster you see, he's destroying their lives!

In theory, they could. In reality, they're not obligated to do that. You don't get to disqualify every judge in your vicinity by just being such an utter dick that nobody likes you.

This isnt TV Most states have one central crime lab that is so backed up they hire an independent contractor if a speedy trial request is made.
Thank you. Most small towns don’t have a dedicated crime lab or CSU or any of that. They send it off to wherever the next biggest city is and hope for the best.

Nick might put up a small fight to get his kids back to save his reputation. He will have to pretend he wants them back. They’re the only reason this “small town good ole family man” routine works. Will he try hard or even be able to do so? Who knows.

Generally, child support is suspended if you lose parental rights. But I have a feeling that varies from state to state, so I’m not 100% sure on the matter.
