Don't mistake my looking at this from a legal perspective as some kind of misplaced sympathy for Nick or Kayla. They absolutely should not have jeopardized the stability of their children's lives by being druggies. They fucked up. This is fully on them.

I don't necessarily want Nick and Kayla in jail (unless the abuse charge was legit instead of some weird typo) but I definitely don't think they will be able to get clean on their own. Addicts almost never can; that's why they're addicts. The couple deserves all the shit-flinging the internet can muster, but they also need help of a local, external variety. While I don't think drugs should be illegal the fact is they are; since that is the case, and the Rekietas are here in this situation, probation and piss tests will do nicely to satisfy that "local, external variety" of help.

4th Amendment violations, for which there is a potential argument in this instance, are notorious for CTRL-Zing entire prosecutions. Given what we know about Nick and Kayla's personalities, their cases getting fully kicked is the worst possible outcome for their family, because it will vindicate them in their own eyes. They will almost certainly forego any kind of sobriety and fall directly back into the same situation.

So while my concern is that the police have mishandled the execution of the search warrant to a degree that gives Nick and Kayla the means to tank the case, my worry is that I'm correct.

I honestly didn't think it would blow up like this and just wanted to point out something that I thought had been overlooked. Now it is at the point were it looks like Metokur used my spoilered images in his stream.

It's hard to say exactly what it means, so for now I'm content to wait until more details come out. All this happened pretty recently, there are likely a lot of things in motion, and I am not expecting certain things pertaining to the kids to be made public so soon (if at all).

The backward document that many have reversed the text on, the one disclosing the pastor's involvement, looks to be just a picture of a document we don't have full access to at the moment (unless I'm mistaken) and could be part of the mandatory reporting from the week prior, but who knows:

At some point that changed, as the police broke the door down and there were charges pertaining to Kayla indicate that she neglected to protect her children from physical/sexual abuse when the Complaint Order for Detention was made.

This could be an error, but what an error to make.

(b) A parent, legal guardian, or caretaker who endangers the child's person or health by:
(1) intentionally or recklessly causing or permitting a child to be placed in a situation likely to substantially harm the child's physical, mental, or emotional health or cause the child's death; or
(2) knowingly causing or permitting the child to be present where any person is selling, manufacturing, possessing immediate precursors or chemical substances with intent to manufacture, or possessing a controlled substance, as defined in section 152.01, subdivision 4, in violation of section 152.021, 152.022, 152.023, 152.024, or 152.0262; is guilty of child endangerment and may be sentenced to imprisonment for not more than 364 days or to payment of a fine of not more than $3,000, or both.
