I have had the thought that one of the older boys might be diddling the other siblings in my head since seeing the charge for Lady Rackets, and I desperately hope it isn't that.

I really really hope someone fucked up the document and she should've gotten the same charge as Nick, because my next best hope after that was Nick was beating on the kids. Everything after that is just horrorcow territory and I don't want to think about it.

So Nick was charged with (609.378.1(b)(2)), which is endangerment from allowing the kids to be around drugs in some manner (selling, manufacturing, possessing immediate precursors or chemical substances with intent to manufacture, or possessing a controlled substance), with additional aggrevating factors if the endagerment leads to substantial harm to the child’s physical, mental, or emotional health.

I'm going to assume then that the kids were around while drug use was happening (duh at this point unfortunately) and that there was some allegation of Nick hitting the children while Kayla was also present. Gonna have to hear more though before I feel any semblance of confidence in that. I don't want to wildly speculate given how fucked the range of possible crimes the Kayla charge could subsume, so this is my reasonable-ish take of what happened

Personally, I'm certain his odds are at 0% because his wife is also a junkie. Cohabitating with a fellow drug abuser is exponentially worse and it will be an impossible task to get clean.

At a minimum, it cuts his chances (and hers) of getting clean in half (probably more) If they don't BOTH get clean and stay clean, the other will almost certainly fall off the wagon- and if even one of them is relapsing, they can't (and shouldn't) get the kids back.

Unless some miracle happens and they both manage to kick it (and lay off the booze, and the gummies, and everything else under the sun) there is a VERY high chance that they either end up divorced, or end up never seeing their kids again and descending together into the pit of addiction and degeneracy until it kills them.

I don't wish that outcome on them, but being shacked up with another addict can easily spiral into an even worse situation unless they BOTH manage to commit to getting clean.

I think you're not understanding the statute. 609.378.1(a)(1) Is neglect by deprivation "deprives a child of necessary food, clothing, shelter, health care, or supervision". Kayla is charged with 609.378.1(a)(2) "knowingly permits the continuing physical or sexual abuse of a child". I don't see why these would be separate, and she would be charged with the second, if 1(a)(2) could also refer to neglect by deprivation.

The police report is ambiguous on this point actually, it says there are two spent casings "on the floor of the nightstand", which could as easily indicate they were recovered where fired and taken home by Nick.

Edit: To clarify, I'm not sure what the "floor of the nightstand" is. It seems to me it could mean inside an open cubby in the bottom of the nightstand, underneath a raised nightstand, on top of a nightstand with a recessed top, etc.
