The way I read it they were tested and then revoked their medical permissions disallowing the info to be released to CPS or something akin to that.
Yes, people are getting confused by conflating the criminal case and the CPS investigation, they are two separate matters. Any outcome of the criminal case could effect the CPS investigation.
Originally Nick and Kayla consented to CPS hair testing and then revoked permission. I don’t know if the criminal investigation is testing the samples anyway, it would be likely. Nick doesn’t have to do any piss tests as part of the criminal investigation because he chose the cash bail. (But anyone who was actually sober would want to submit to testing because it would help their case.)
All the CPS hair test would have done is confirmed they had used multiple illegal substances so not surprised they yoinked that. People that consent to it are usually doing so to prove they are innocent of using drugs. (Like when kids are removed from a home for drug abuse, but it’s only one parent abusing drugs. The other parent wants to be tested to prove she/he isn’t the problem.)
CPS has apparently visited the house and asked to see the premises - specifically the bedroom - and were refused. The criminal case had a warrant and didn’t need permission they just went in and collected evidence.
CPS can’t assume guilt just because parents are arrested so they give the parents voluntary opportunities to get custody back while a criminal case proceeds. This is why CPS had the kids hair tested independently of the criminal investigation and Nick couldn’t stop it. It’s why they offered to let Nick and Kayla submit to drug testing and house inspection, but they refused.
The refusal, lack of cooperation, is a huge red flag to CPS and indicates there are major safety issues in the home that make it unfit. Any sane, non-addict parent would say test me, look at my home, give me my kids back now! Addicts refuse to cooperate because any testing or cooperation will strength the case against them. But refusal is only slightly better than a hot piss test, because refusal indicates active use.
Nick and Kayla decided to choose drugs over their kids because they are addicts. The humiliation of peeing in a cup is nothing compared to your kids being in foster care, but Nick can’t submit to it because he’s still using. Nick has chosen that hill to die on.
He cares far more about his drugs and banging his side piece than he does his five kids, but we already knew that. I think ppl just hoped a few weeks post arrest he might get sober and start giving a fuck about his kids, but nothing has changed.
