No, but you can influence them. This line is a classic hallmark of people who don't want to take responsibility for the fact that their actions can have a negative effect on other people. Sure, people shouldn't be easily influenced and that's on them to an extent, but it's also on you if you're being a bad influence. It goes both ways.

Well, the argument, which I'm not really taking that seriously, and don't really think it changes the situation much even if true, is they deliberately stopped him to keep him from getting to the house, so they could bust in the door in the absence of a consenting adult. The problem is Kayla was there.

What was she doing while all of this was going on? Was she in a drug coma, completely unable to respond to loud noises? Why was a child responding to the door with an adult present?

That said, the factual correction is important, and it is important to be accurate. Nick wasn't at the front door refusing to give out the door passcode after being handed a warrant. He was pulled over somewhere else on the way there, whether that was a deliberate stratagem or not. They had already battered down the door by the time Nick was there, and it was AFTER that that he THREW IT ON THE GROUND!

The fact that only a child was able to answer the door while an adult was present suggests the adult was completely incapacitated and given an actual warrant, and a refusal to allow entry by any responsible adult, whether or not this was a sleazeball move by the cops (it might have been), knocking down the door is generally going to be considered a correct answer here.

They already established probable cause by the existence of the warrant, but that by itself might constitute exigent circumstances even without a warrant.

Yeah I'm dropping out. Nick is super mega busy, but apparently he still has the time to watch everyone who talks about him - so I don't think we will learn anything from those two.
Although I will say that prior to Nick sending that supachat, Drexel appeared to be sort of distancing himself from Nick, talking about how it's a grown mans' choice to do drugs and such. But nothing dramatic. They'll just keep bitchin' about women for next few hrs.

Not really. I don’t think the home school capsule people are mandatory reporters, they are other parents that teach. I don’t believe they would be required mandatory reporters. I would think the only actual mandatory reporters were at the church, the pastor and possibly the pre-school teacher (if it was a licensed daycare program she would be). It sounds like the kids attended a pre-school program there at some point. (No idea if it was weekday preschool or just a church program for littles to attend while adults got to church.)

I definitely think the church knew things were off and tried for quite awhile to get through to Nick without resorting to reporting him to CPS. No idea when the line was crossed that made him realize he had go to the authorities. It would seem after three or four different people went to the pastor he finally felt he had to act.

I think Nick was reported by several non-mandatory reporters, including his own SIL, because shit was so bad people acted on their own volition, not due to any legal requirement. I don’t think Nick’s kids had many mandatory reporters in their lives, but they luckily did have people who cared.
 
Just because 2 people are fucking doesn't mean they like or love each other, even if they are married. Nick learning at 39 that his parents are "still doing it" while saying he "doesn't even know if they like each other" in same breath doesn't confirm they like or love each other at all.

On the other hand kids of parents that love each other don't have doubts about whether their mom and dad "like" each other. They know they love each other because they are witnessing the affection between them daily, and not because they have confirmation parents are "still doing it"
I find Nick acting puzzled about this to be kind of funny considering his own romantic life. Unless he is just playing dumb for the public, you would think his own experiences and behavior would have given him insight that people who have sex regularly may not actually care for one another.

If sending a child to answer the door to deny entry was enough to invalidate or delay a search warrant then everyone would do it, it would at least give them time to flush their stash. The Police made an attempt, that's really all they have to do and at most they would be liable for a new door.

I dont think detaining Nick away from the house while the warrant was executed was all that unusual. The document is however unclear as to how the warrant was served. It indicates that Nick later asked for and received a copy of the warrant, but he may (or may not) have been officially served with the warrant before that time. This is one of those process things that police usually don't get wrong. But if they did get it wrong, it opens up a small window for Nick.

I would guess that the body cam footage of Nick will clear most of this up.

but like, again, he doesn't need to be there for them to execute the warrant. and if he didn't give them the door code because he didn't believe there was a warrant or that the warrant was legit, and nobody answered the door (but adults were present in the house), then even if he wasn't in the wrong, that doesn't imply that the cops were in the wrong either. there's standard procedure for this. again, i just really don't think these details matter especially with two adults at the house. maybe i'm still missing something.
