Purdue Pharma L.P. that the bankruptcy code does not authorize a multi-billion-dollar bankruptcy plan for Purdue Pharma, the maker of the highly addictive opioid painkiller OxyContin, that would release members of the Sackler family, which owned the company but did not declare bankruptcy, from any future liability for claims against them.

Recognizing the flaws in the Government’s theory and Idaho’s “strong” likelihood of success, this Court stayed the preliminary injunction pending appeal on January 5. And, wisely or not, the Court also took the unusual step of granting certiorari before Idaho’s appeal was heard by the Ninth Circuit. See this Court’s Rule 11. Now the Court dismisses the writ and, what is worse, vacates the stay.

This about-face is baffling. Nothing legally relevant has occurred since January 5. And the underlying issue in this case—whether EMTALA requires hospitals to perform abortions in some circumstances—is a straightforward question of statutory interpretation. It is squarely presented by the decision below, and it has been exhaustively briefed and argued. In addition to the parties’ briefs, we received 46 amicus briefs, including briefs submitted by 44 States and the District of Columbia; briefs expressing the views of 379 Members of Congress; and briefs from prominent medical organizations. Altogether, we have more than 1,300 pages of briefing to assist us, and we heard nearly two hours of argument. Everything there is to say about the statutory interpretation question has probably been said many times over. That question is as ripe for decision as it ever will be. Apparently, the Court has simply lost the will to decide the easy but emotional and highly politicized question that the case presents. That is regrettable.

Having already taken the extraordinary step of granting certiorari before judgment in order to decide whether the Government’s new interpretation of EMTALA is correct, we have no good reason to change course now. This is especially so because the Court’s decision to reexamine the stay issued in January makes it necessary to reassess whether Idaho showed a likelihood of success on the merits, a question that is closely related to the question whether Idaho or the Government has correctly interpreted EMTALA. Residents of multiple American states are being urged to limit or avoid driving gas and diesel-powered vehicles where possible today due to air quality fears.

The federal National Weather Service has issued a number of Air Quality Alerts across the U.S. meaning that "ground level ozone within the region may approach or exceed unhealthy standards."

Large areas of the Northeast, East Coast, Midwest and South are currently sweltering under a heat dome, which is created when warm air is trapped beneath an area of high-pressure for an extended period causing temperatures to surge. These conditions typically cause ozone levels to also surge, which can lead to lung damage, asthma attacks and breathing difficulties, especially dangerous for children and the elderly.

People in Ohio's Miami Valley are being urged to "carpool, if possible, bike, walk or take the bus instead of driving alone" to help improve air quality. The NWS also says those living in this area should only refuel their vehicles after 8pm, avoid idling any vehicles and avoid gas-powered lawn equipment. This advice is in effect until midnight tonight.

The same advice is in effect for Butler, Clermont, Hamilton and Warren counties in Ohio Dearborn County in Indiana and Butler, Clermont, Hamilton and Warren counties in Ohio until midnight with an alert having been issued by the Southwest Ohio Air Quality Agency.

In Colorado, an ozone action day alert is in place across the front range urban corridor, covering the counties of Douglas, Jefferson, Denver, western Arapahoe, western Adams, Broomfield, Boulder, Larimer, and Weld. People in these areas are requested to "limit driving gas and diesel-powered vehicles" until at least 4 p.m. on Saturday.

According to the NWS "the highest ozone concentrations on Saturday are likely for locations in and near the Denver metro area, especially for southern and western locations during the afternoon and early evening hours."

The Alabama Department of Environmental Management has decreed an air quality alert for Shelby and Jefferson counties which is due to last until the end of Saturday.

Those in these counties are urged to "limit driving and combine errands," "limit engine idling" and "refuel cars and trucks after 6 p.m. The warning also says people should "avoid use of gasoline power lawn and garden equipment" and "use household, workshop, and garden chemicals in ways that keep evaporation to a minimum." People are advised to go inside if they find breathing difficult.

Similarly the Indiana Department of Environmental Management has issued an air quality alert covering the cities of Richmond, Connersville, Liberty, West College Corner, Brookville, Batesville, Milan, Versailles, Osgood, Rising Sun and Vevay until the end of Saturday.

The NWS is also warning people not to leave children or pets in cars in parts of New Jersey, Pennsylvania and Delaware due to potentially lethal temperatures.

They said: "Do not leave young children and pets in unattended vehicles. Car interiors will reach lethal temperatures in a matter of minutes." This heat warning applies until 6 a.m. ET on Sunday for some areas.

Separately firefighters in California are battling a number of ongoing infernos, including the 'Post Fire' which has been burning since June 15 and has rolled over at least 15,690 acres of land in Los Angeles and Ventura counties.

The EPA also added ozone to AQI which makes the statistic useless. An AQI of 150 due to ozone is unnoticeable while an AQI of 150 due to particulate pollution is so bad that you can't see across the street and it hurts to breathe. The EPA did not go after California, Oregon, and Washington for polluting downwind states with their wildfire smoke so this was just a tool for "degrowth" of politically unfavored areas.

Damn Alito is pretty salty

He might be the one SCotUS judge who cares more about the processes of the court then any agenda. He's royally pissed that the other judges voted for certification before the case is even complete and he has a good point even if we know no matter who wins that case the other party will appeal but by going out and saying the SCotUS will accept the appeal they're basically wasting the lower courts time because no matter how that judge rules the case will be before the SCotUS no matter what. That's an abuse of process IMHO.

He's pretty much come out and publicly chastised the other judges on the court for putting their political agenda's before the process. To Alito the process of Law is critical for the proper operation of the justice system and he ain't wrong.
