If Nick or Kayla make that claim, the only way to make it is with firsthand knowledge that Aaron did it and firsthand knowledge makes them guilty of neglect and they lose the CPS case. If April accuses Aaron of it based on firsthand knowledge of Aaron doing it, she opens herself up to criminal charges.

Even if Aaron made a public confession that he did it, Nick and Kayla would still lose the CPS case. They opened their house and gave access to their children to a person who gave one of their children cocaine. Nick can't turn his house into a drug den and then say he isn't responsible for the actions of others toward his children in his drug den. That is losing argument in the CPS process.

By the looks of it, Balldo himself wants a jury trial. How does it look like for the prosecutor? Would they prefer a settlement and be done with it? Would they also like a trial and nail his ass?

Would his bullshit on youtube affect them in any way (I mean, on a human level. Could they get mad at him and could that influence their decision making) ?

They have a very solid case. They got him with a significant amount of drugs and the probable cause the warrant would look from a prosecutors point of view difficult to attack. Having one of the kids test positive for cocaine also means the child neglect charges would look really solid as well. The gun related charge is about the only uncertainity and its only uncertain because not all the evidence and testing has been disclosed IMO.

To a prosecutor, doing a jury trial on this case is going to look like a waste of time and money. The likelihood of him being found guilty is very high and the sentence he is likely to get is equally predictable. A case with a Barnes-like Attorney making a constitutional law defense would be especially annoying and time consuming.

Some prosecutors might increase the charges or try to figure out a worse outcome in sentencing for Nick if he fights it to a jury trial. With the positive test for cocaine in the kid, they could certainly up the child neglect charge.

Call me naive but I disagree. I think until he got a lot of attention he was a decent guy. The story here isn't really that of a master manipulator but rather how incedious corruption is.

It was one vice after another and another chasing a bigger and bigger high.

Ultimately he's a first time offender and non-violent. He seems like he is being careful about not accusing the court, prosecutor and police of wrongdoing. They'll likely offer him a plea deal of deferred adjudication with conditions including testing, rehab, etc. The plea deal will likely downgrade the weight to reduce the sentence so take the plea with 20 mos presumptive and deferred or trial facing 48 mos presumptive with guilty verdict.

Unless he keeps saying people lie about guilt to get plea deals.

Aaron also admitted that April's been siphoning thousands of $$$ out of their joint bank account after she left him while they were legally married (unless Blondie can prove this cash was to pay a downpayment on the house next door, this may lead to probable cause that Imholte funds were used to buy coke).

My guess is that the kids has been so unwatched that they just play with their internet devices all day long at nick's house and at the foster house they're more restricted. Depending on how far gone they are mentally (emphasis: due to nick's and kayla's neglect), they might prefer the 24/7 internet access as opposed to clean clothes and fresh food. They might even think "well, now that the gubment got to dad and mom, maybe they'll do the bare minimum and we still get to play all day again"

There's a super cynical part of me that occasionally thinks it's because he doesn't really want the kids back, he thinks he can make content out of this saga, and that there's a hail merry chance he gets off scott free and then can do a victory tour and clear his name with the public or something. But even at my most cynical I find it hard to believe that.

Family court is far more casual. The point would be to accuse the one person who Nick does not have on his side—the person with TWO restraining orders against him who discussed coke being near his kid.

Three against one. Do you honestly think Nick isn't trying to leverage that advantage?

(Also, Aaron's not going to face criminal charges, though he wedged a door open. What is in play? Ashley has leverage for full custody.)
 
This isn't the win that he thinks this is. He was the kid's guardian. You are responsible for your kid. Being fucked up on booze and cocaine, then someone that you invite to your house, who drugs your children while you are passed out is the guardian's failure.
And it's not like this was the 16-year-old acting out, I think most parents would at least sympathise with older teens being risk-taking and hard to control, this was an 8-year-who who by all means should never have even seen coke let along ingested it under his guardianship. No normal parent has this issue, it doesn't even come close to happening because it's so absurd for a young child to be around this stuff if you're a half-functional person. And no matter what cRazY weIrD situation he can pin the blame on, he should've been there as a parent to stop her, or should've stopped the situation from developing entirely (LIKE BY NOT HAVING COKE IN THE HOUSE). Even if he takes the approach of blaming Aaron, he let someone be around his kids with drugs. That's not a win that's fucking disgusting.

Nick is known to make terrible choices with Lawyers, recommending a business and estate lawyer for Vic's defamation trial, hiring the flashy and expensive "tv/radio Lawyer" Marc Randazza instead of a more sensible local lawyer who is better versed in Minnesota Defamation law, now he's hiring yet another constitutional lawyer for a case that has nothing to do with the constitution.

If Nick is planning to pull out the constitution at a district court then he's incredibly desperate and at this point should probably just take a plea deal, we've already seen Nick's "Barnes Recommended" constitutional lawyer stumble at the local law level with his attempts to keep information supressed showing he has no clue what he's doing.

If Nick takes this to trial then the Prosecution are going to nail him to the wall with everything they have, but in truth a win through a plea deal is a win through less effort and Nick could probably get something decent if he took a moment to get his head out of his own arse and take responsibility.

Maybe having this shitty Barnes Recommended lawyer is Karma for fucking over Vic.

The presumptive sentence for 1st time offender with that amount is 48mos.

He's "fighting" it only because there is nothing else to do. It's more accurate to say he is "waiting." The state is waiting for lab results. In August the state will present probable cause for the charges to the court. Nick can challenge the warrant and evidence at that hearing. Before that hearing but after all the lab tests are back, Nick will likely get a plea offer. Probably after that hearing too as he will not get evidence thrown out. The plea will likely be too good to decline (20mos of deferred adjudication w/ rehab, probation, drug tests, etc).
