Everything we've seen from the CPS so far has shown them being cautious and methodical in gathering facts rather than attempting to reunite them in the near future. This is pretty much it. I believe in some of the recent documentation, Nick's attorney had submitting a motion requesting that the court return the children to his custody.....or do about seven lesser different things that would increase his access to the children.

I further believe that the next hearing is toward the later part of August and could maybe be considered to be within Nick's definition of weeks or shortly.

I would guess in Nick's mind he is going to win back complete custody, the GAL will be removed and everything in the case kept private from the public. Its Nick lying to himself or the members of his cult about the situation.

Would saying the CPS accusations were all a pack of lies and accusing Aleisha Sweep of perjury to an audience of thousands have any influence on a sane judge? It doesn’t exactly reflect acceptance of accountability or desire to do better for his kids next time. After all, he’s claiming they were perfectly safe and cared for all along.

The court’s primary duty of care is to the children. Sending them back to an unrepentant drug addict isn’t in their best interests, even if Merry Maids has spent the past two months trying to whip their crack house into a crack home. I’d hope the kids’ attorneys and GAL would stand up for them as they are sworn to do.

Train Operator posted about this on the Comics Gate thread. EVS was talking trash about Rekieta. He talked about how Nick is being defiant of the law, how he brought April to the tattoo convention, and how April is now being charged with crimes along with Nick and Kayla.

It's called the Minnesota State Legislature. If he thinks the statue as written is dumb, they are who he should try to convince of that.

I don't see it working in the judicial branch though. A strict reading of the statute yields that if there were drugs in the same house as the children (which there were), the court is to presume the children were at risk. I also don't see any obvious legal problems with the statute, as currently written.

Notably, at no point during that CPS hearing did he appear to argue there were not drugs in the house.

I don't agree with this.

Yes, the amount she would be required to ingest would be proportionally smaller. Assuming she was in the lower average weight range, because she wasn't being looked after properly, she would need to be taking about 1/3rd of what a regular user would take.

This isn't by any means precise, but we could be talking about the equivalent of multiple bumps a week. This isn't the amount that just happens to get stuck to your food, or hands or whatever as you move through the Rekieta crack home. It's noticeable.

Maybe she got into the stash - I think they gave it to her now I've seen Nick's testimony pre-empting a positive test.
