I think Mike makes a good point at the outset in that the LAWLsuit revolves around a civil rights violation - specifically the right to be safe from "unlawful" search and seizure - but it kind of falls apart in that he's saying that a welfare check wouldn't meet the definition of an "exigent circumstance" the way these other events would have; the problem I see is that the mere presence of the police on a person's property [in response to a 911 call claiming some sort of criminality is going down] doesn't come close to an "unlawful" search, even if the call is for nothing more than a "welfare check". I don't believe anything has ever actually been "seized" from his property, and how much of a "search" of the property have they ever executed aside from, perhaps, a general walk-through searching for a potential victim of criminal violence? Have they torn his property apart searching for weapons/contraband? Done some significant amount of property damage? Harmed either Fatboy or the subhuman dyke? So where, aside from Fatboy's 1.2-inspired belief that the cops should simply believe he is a "victim" of "swaTTing", does he get the idea that the police doing the minimum of their jobs and checking to make sure there is not a legitimate shooting victim on the premises somehow "unlawful"?

While the statement that in general a 12(b)(6) motion to dismiss is a high bar to pass is true, it is not so much in the specific case of a § 1983 suit, where the police are protected by qualified immunity. Pat has to establish that they've violated "clearly established law." Even if the court finds that he's stated an actual violation of constitutional rights, if it wasn't already "clearly established" before now that police showing up in response to a 911 call is unconstitutional (it isn't), he still loses, because it wasn't "clearly established." Only the next person to get their rights violated by police showing up in response to a 911 call can take advantage of the precedent.
So it's ordinarily a high bar to clear, but in this case, it should be a slam dunk. Civil rights actions like this are thrown out all the time.
That said, I'd love to see discovery, because of the certainty that it would turn up more embarrassing shit about Piggy, and even possibly might turn up evidence he was calling in this shit on himself solely to generate material for a lawsuit like torswats claimed. That would be a serious crime and Pat would get to enjoy prison.
The most boring option would be settling it for nuisance value.
