What does interest me is that they're claiming here April was questioned by Detective Pomplun after she was read her Miranda rights and asked for a lawyer, and after Pomplun was told she had asked for a lawyer:

This says the cop viewed the video on the 22nd that were taken off of Youtube and Rumble, at an earlier time. Nick didn't private the videos until 10:30 the next day since he was wasted and passed out, so they were public for about 10 hours on the 21st. The cop could have easily archived the videos in that time, then made time on the 22nd to watch his archived version. Nick is trying to lie and make it seem like the stream was never public and there's no way the cops could have gotten it on without a warrant to Google.

Ok - So going through the arguments:

- Nick claims that if the warrant probable cause was based on watching a clip rather than the original video, that its invalid. There is no chance of this going anywhere IMO. Its a stupid argument.
- They want to claim that a previous CPS decision on Rekeita precludes them from seeking any warrant in future. That the judge not being informed of the previous CPS decision invalidates the warrant. This is the strongest argument they present (though still not very strong), but it going anywhere will depend on the response to the motion and what is presented.
- Nick does alot of whining about his lover's tiff with Aaron in the motion. It doesn't really add anything and just makes Nick look like even more of a gay crybaby.

- All the Muh Second Amendment stuff with regard to them taking Nick's guns during the search warrant is a waste of everyone's time. Its just a bad argument legally.

- The argument about April's statements to police might or might not work. It depends on a whole bunch of complicated legal factors that the motion doesn't go into and would require information from the interrogation interaction that is not available to the public at present. Its very easy for someone talking to the police to unintentionally void their miranda protections. But without the cam footage, its difficult to know.

Kayla's lawyer is the same lawyer she already had for the CHIPS stuff, who has been apparently been working alongside the Barneswalker who's also representing Nick on the CHIPS case based on the public documents that have been posted here, and could have been retained at any time.

The only reason I can think of to file the certificate of representation on the Sunday on the same day that Nick files the motion to dismiss is to try to delay the hearing by using it as an excuse for a continuance. That's certainly what it looks like, anyway

Yes, that's why the cutoff for the tests being positive is a 500 pg/mg, and a more thorough test would also see the ratios of the other metabolites to tell if it was external contamination or not.

BUT, the thing that throws me on a loop is the 5000 pg/mg number that they detected on the Balldoman spawn. I don't see how Nick can (the tests being accurate that is) even try to weasel his way out of that high of a number.

Nick has filed for a motion to dismiss based on lack of probable cause. Reading through it now. Already Nick claims that the appeals loss coke stream is inadmissible because it was clipped from the original and makes him look bad lmao.

-Nick states that his coke stream that he has since deleted off of YouTube can’t be used as evidence because any copy of it is considered a clipped copy and may misrepresent his words.
-He claims that since the stream was privated, that in order for Aaron to have legally viewed the stream, he would’ve needed to have served a warrant to Google and Alphabet for the 4 hour stream.
-Nick claims that because April willingly gave statements after she was mirandized and asked for a lawyer, those statements should be thrown out.

The whole thing feels like Nick is grasping at straws. Just throwing stuff at the wall hoping it sticks.
There exist whole (unaltered) archives of the live stream in question (should you download them using a YT to mp4 converter). And besides, it's not as if the state can't get a warrant to have Google/Alphabet send the stream/archive as well (possible that they already have).

If you give statements after asking for a lawyer, it depends on the context. Was she continually being asked questions? If so, that seems to be the only thing that sticks. But I doubt this is true, or that it'll help much.

I'm not sure a deal's still on the table for Nick, (either mentally -- as in whether he'll consider it or not, or literally) given the approach of this attempt at defense.

I came back just to say Nick is a faggot for trying to get a continuance like this. It has been almost three months since the arrest. A last minute motion to delay filed this morning, and against the wrong fucking hearing, would be more hilarious if people weren't trying to attend.

You know, it would be funny if he manages to suppress everything, and yet nonetheless, he gets found guilty. And when he tries to appeal, the appeals court goes point by point stating how he has nothing to fall on, and everything was fair (by his own admission through arguments to seal and supress during the process of the case).

Its a three-part argument:
1) You can't hold the statements of my former gay lover Aaron against me because we don't like each other anymore. Perhaps Nick in the next motion will claim that he and Aaron were common law married. It would be difficult for him to come across as any more gay than he did in that part of the motion.
2) CPS can never investigate me again because they once investigated me and didn't find sufficient evidence of neglect at that time.
3) If you didn't watch a stream live in its initial broadcast, whatever happened in that stream doesn't count because Internet Boomers.
