He might ask for it as part of a plea so that he can claim "Well, technically this is a W for me because even though I was convicted by the unjust state I never cucked (figuratively, I did literally, a lot) and admitted that I was guilty."

But the argument its not even "the video could be faked." Nick, via White, is straight up claiming the video has been altered from the original. In support of that, he cites Cog's logo, which (as @Balldo's Gate points out) is not a watermark, but something that appears when you mouse over the video on Youtube. That is to say, it's not something in the raw video data, but an overlay.

It's a disingenuous argument meant to sow confusion. I expect nothing less from Nick's corner these days.

Pretty sure there's no best evidence requirement for a probable cause affidavit in support of a warrant. That would be a trial issue, if it were an issue at all. Nick's argument is equivalent to saying that an audio recording that is broadcast in its entirety on a television news segment could not be used by the police in support of a warrant. Or a social media post that is screenshotted and then republished by someone else could not be used by the police.

It's just dumb, though it doesn't look like there's a published Minnesota case that is exactly on point.

Does this seriously happen? Do small town judges actually throw out heaps of evidence acquired via warrant in cases like these? It just seems like such a faggoty longshot if he expects it to actually work. If he's truly a 5d chess aficionado and this is his only play, Jesus Christ.
 
Nick had an 'expert' on his witness list that was on his 3rd or 4th career after drug testing and is currently some YouTube/Social Media guy. His credentials were laughable.

The guy who insists all breathalyzers or drug tests are wrong every single time, etc. Even proscutors constantly bring in absolute bullshit "experts."

I have two copies that I created of this stream. This one doesn't have a video ident for it so I either created this off of YouTube or acquired it from someone else the day of. It has the coke nose.

That Odysee video is now altered. In fact, it looks like a post-arrest video because the pictures are hanging, so he for sure edited this after his arrest. Because Odysee uses LBRY on the blockchain, @Haru Okumura may be able to precisely pinpoint when he edited his claim on this video. This might just be an Odysee player issue. This video actually does show the coke, too.

What kind of 200IQ move is it to private the (as far as we know) unaltered streams, leave up the Odysee stream, but then modify it in a way that is immediately obvious via the background in the stream/his attire? I am genuinely baffled, is he just counting on the prosecution team, the police department and the court being idiots?

EDIT: It seems like the Odysee thing may have been a bug. On a cursory scrub through the stream, it appears to be unaltered. Honestly though I'm still wondering why he hasn't taken that down if he privated everything else.

I doubt it. Unless there's a pretty clear Constitutional violation in collecting the evidence. Fischer is also a colleague of the judge on his case now, and I don't think the the standard for probable cause is really as high as Barnes thinks it is. It's called "probable cause," not "absolute certainty." But, as always, INAL.

Part of me thinks the main immediate outcome (other than the case proceeding) if the motion is denied, and the evidence stays in, is that Barnes can scream more about "small town corruption, Nick is innocent!"

Because he can. Seriously, 99% of people on this website are complete retards. Just because you will take a deal doesn’t mean you’re not going to try every trick in the book to get a case thrown out before you get to that point.

The criminal justice system exists to put dumb gorilla niggers in prison. Affluent white people only go to prison when they are (a) inconvenient to the political regime or (b) did something really, really stupid with tons of direct evidence to the point that they can’t get out of it or (c) just have boneheaded representation (like representing themselves) or (d) want their ‘day in court’.

Believe it or not, (d) is probably the most common thing that gets people convicted. People think they are special or what they did was justified or just want to tell their story. They have an intrinsic desire to make the truth known and that’s what gets them in prison. But Nick already has a soapbox and has no need to turn his case into a spectacle. Best case he’s going to remain a free man with maybe some minor probationary restrictions.
 
All I’m hearing right now is that Ultra Mega Divorce Rape is not just on the table, but potentially sodomizing Nick on the table (it’s using protection so it doesn’t get his gay cancer).

If this ends with Kayla turning on Nick with her getting the houses while Nick has to live in a van down by the river eating government cheese, I will be very happy.
