Trashfire The August 21st Omnibus Hearing for Nick Rekieta

So is the coke stream video absolutely necessary for the warrant or are other parts like concerned citizens enough to keep it?

Their argument is that since the video was part of the warrant, it should be tossed.

The warrant is VERY thorough on everything the cop used to determine the warrant was needed and got it signed by the judge, with the video being a small part of that.

If the video was inadmissible (which would be retarded, Nick broadcast himself, it shouldn't matter if the copy is second hand. It's the photo of a photo argument) I don't know why the full warrant would be tossed if the mandatory reporters/etc information was still enough for a reasonable warrant?

So we've got an up to two week wait for the evidentiary hearing, then we have a 1 month+ wait for ANOTHER omnibus hearing? I feel like Nick's strategy is just to stretch this thing so that the prosecutor doesn't think it's worth the time/money to wade through all the extensions and throws him a sweet deal.
This is how court cases commonly go.

Ralph is reaching his 2020 levels of spiteful and maliciousness. Everything he says and does lately is just intended to annoy and/or intimidate. He's always a been a ragehog but it's not often he gets this nasty, I wonder what brought him back to this level.

Simple as.

God damn, I’ve watched trials irl before and people could just use their phones in the courtroom (these were low profile cases where the judge could give less than a fuck if he could).

I hope no farmers lost PTO for this non-event.

> Have a job from which to lose said PTO in the first place
or
> Be Ethan Ralph, doing whatever the fuck it is you're doing with your life

Yeah I think I'd prefer the former.

Hypothetically, if the warrant is voided, how would that affect the family court case and all the deals he has made in regards to custody? Would those also be eliminated considering all the drug testing and removal stemmed from the arrest and search for drugs?
Not if it's CPS, they don't have the same evidential standard. He's not getting criminally charged and he has the kids back anyway, so there's not much point.

Leggings and tank top is how you go to the gym, not the court room. Do they not own a modest dress or normal pants? long sleeve blouse? Very white trash.
Going by the police report, they probably do have nicer clothes. But they are all in an unwashed pile of filth, food and moss on the living room. Hell, Nick probably ordered his wifes to find him the best non-smelling shirt from the pile for his appearance.

If the judge rules that it was an unauthenticated copy then the warrant can be tossed regardless of whether they can authenticate it today.
It literally doesn't matter. All the cop needed was a reasonable basis to believe it was legitimate. And even without the cokestream, they had multiple reports from mandatory reporters.
The prosecutor probably acquiesced.

It would be odd for the judge to make that ruling without knowing what April said and for the prosecutor not to request time to respond like with the warrant issue.
I am drawing inferences here, but I doubt the prosecutor could even claim credibly that whatever April said wouldn't be being introduced at trial as evidence of Nick's guilt, that is, for the truth of the matter asserted, and would thus be subject to hearsay/confrontation issues. I wish them luck in obtaining her testimony at trial.

Funny how they recently charged her. I wonder why they did that.

While it was reallly poorly argued we mostly agreed it was likely the April stuff was not admissable at trial (unless she pleads and turns on him and testifies) and they'd probably better get a better copy of the cokestream if they want it in at trial.
IANAL, but the judge made it pretty clear that only parts of the body cam footage can't be admissable.

That doesn't throw out the warrant. The warrant AFAWK was made from concerned citizens who are able to make such a report. Claiming the cokestream was edited is Nick doing the scummy "Prove it's not fake" bit, but doesn't this open him to the prosecution then subpoenaing him for the original footage? And when he provides them with nothing, or poorly edited footage, he's ass fucked.

Let's face it, I don't put it past Nick at all. He will absolutely turn in nothing and refuse to provide them with a copy of the stream claiming he doesn't have it, or worse-Edit his own copy of it because he's fucking stupid enough to think he'll get away with it. And then what? "Well your honor, I don't have the evidence they're asking for..."

Fantastic. Maybe you could get away with this but making your entire defense hinder on this now missing and supposedly edited stream, combined with testimony from Child Services of him refusing to detail how coke wound up in the home, Balldo is still ass fucked. And if the judge and prosecution feel ornery enough, can't they really fuck him hard for this garbage? Prosecutions case seems strong enough with or without April's testimony.

I can't see how April's testimony or statements to the police matter much.

I would imagine its really about Nick continuing his strategy of attempting to win the case by proving that there is no evidence he ever used cocaine. Or even more absurdly its about Nick trying to exclude something that will make him look bad outside of the courtroom but has no bearing on the case.

They are both trash women. I think there's general agreement on that point now.
I’m stunned to learn there might have ever been a lack of consensus on this. Just look at them.

Kayla apparently doesn't care either, She let Ralph touch her. Absolutely disgusting.
All of these people have descended to a level of utterly putrid degradation that few realize is attainable outside of Section 8 housing. And Nick, who (out of fear of losing Dipshit Dax’s friendship) has been cozying up to the convicted sex offender who called his children retards, is the most shameless cuck in the history of the internet. That’s saying a lot.
