I'm hoping he clarifies it enough in his reply such that the prosecutor cures the evidence problem before trial but doesn't affect the search warrant. It would be hilarious if he could have had it tossed at trial due to the higher evidentiary bar but tipped off the prosecutor to correct the error with his pre-trial Barnestardation.

It would be sweet justice if Barnes was not just wrong about the 2nd, 4th, 5th, 6th, and 8th amendments regarding the search warrant but that all his sperging actually cured real trial issues for the prosecution that would have led to acquittal.
I doubt the video would be used at trial, as it has no relation to possessing drugs or not.

I suspect what Nick's lawyer will do in the next few days is say the cop said he reviewed the video "that was taken off of" Nick's YouTube and Rumble. The lawyer will say "taken off of" means directly from and say this isn't possible, because it was set to hide. Essentially claiming the cop used evidence obtained by illicit means and lied to the court in the process.

The state has a re-upload, but nicks motion seems to allege they just had the clip.

It's all moot, the re-upload is substantially the same video and pomplun didn't lie so this shouldn't trigger franks
The timeline is not clear, and I don't think the document explicitly specifies the YouTube video. Most people are making the not unreasonable assumption that when the author writes "On 5/22/2024, Your Affiant was able to review the video ... " that this was done online at that time. However, it's possible the video was downloaded previously and then reviewed later. Also, as other's have mentioned, the Odysee video was still up at this time.

So, not 100% clear that the state must have a reupload. As you say, moot, or "doesn't fucking matter" anyway.

It was possible though because Nick didn't private it until the middle of the next day. It was up for like 10-12 hours IIRC until Nick regained consciousness. Many people here downloaded the replay directly from Nick's YT channel during that time and the removal was documented in this thread in real time. The video is still up on Nick's Odysee channel too for whatever reason. That argument is disingenuous at best.

It is also irrelevant where he [Pomplun] watched the video, as long as he could reasonably assume it was an authentic unaltered copy of the stream.
If they want to challenge that the video of the coke stream, copied and uploaded to another channel, should not be allowed as evidence then they should start making that argument and offer affidavits, testimony and actual timestamped comparisons of the REAL video and the "altered copy" to support that claim.

No evidence, no Franks, no suppressing of the search.

The thing about Barnes and lawyers like him is that they don't represent innocent people. Innocent people don't need sleazebag attorneys willing to use sleazebag attorney tactics. People who are guilty as fuck hire Barnes. The only innocent people briefly working with Barnes ended up quickly telling him to get the fuck out publicly (like Rittenhouse and Sandman). Even Trump distanced himself from Barnes and he traveled in some very shady circles.

Divorce seems likely. In court documents now his wife is on record as sending nudes to Aaron. To do that just to score a victory against Aaron is low. I'd imagine the prosecutor is going to offer a plea deal early on and have him eat the misdemeanor, which is honestly fair. It was a dick and dumb move, but for the life of me I can't see this is good for Nick's family.

I just read it literally. The video that was taken off of (removed) from Nick's Rumble & YouTube was able to be reviewed. The cop doesn't say where. Not important.

After reading the prosecution reply you see how all over the place the motion from Nick's lawyer is, especially on the video.
