The entire case against Nick and Kayla hinges on the drugs being in the house and the judge just ruled that the drugs were in the house.
Case closed. They are both not winning because the judge found it to be a fact that the drugs were there.
That's only for the purposes of this motion. Ultimately, Nick has a right to a jury trial on all factual issues.

I get that it's kind of counterintuitive to think about, but the more you know about the probability underlying it all, the more it checks out.

In this context, Balldo knew that a judge gave a bad outcome, and rolled the bones on a better. The parallel is a little strained, but I imagine someone with a better legal grasp could explain it using Bayesian principles.
You can also get there with a frequentist approach by just outlining every single possible outcome for both approaches and then counting them.
