Honestly if the judge finds a way to support Greer after the latest insanity, and not even putting forth a schedule to move forward, it should be a slam dunk to dismiss the case.
It should, but God knows what will happen. This case started more than 4 years ago and has gotten crazier and crazier and crazier. It's a complete shit show.
It's been a wild ride and having to pay for this insane litigation is the perfect picture of the legal system in this day and age. It's just insane.

It should have been when Hardin pointed out that the judge was basically acting as Russ’ counsel. As it stands the case is ripe for appeal, but that’s not really the point. The point is it’s bankrupting Null, and that seems to be the aim of the judge. The judge probably knows it’ll be dismissed eventually on a technicality, but has no problem dragging it on procedurally and passively in order to extract every Moon-shekel possible to teach illiberal intolerant kiwis a lesson about caring and sharing.

I … don’t think it is? It’s just annoying as fuck to have to pay Hardin for the retard tax but IIRC most of the money spent so far has been to help fix Australia.

If it IS costing much let us know and I’ll kick in some more, as these are some prime content creations.
 
I do hope after all this is over that there is some recourse against the judge for the way he has handled this case (feel free to list his sins). There is presumably some judicial standards body that ought to be informed.

Christ:  By way of counterexample: in 1997 West Virginia Judge Troisi became so irritated with a rude defendant, he stepped down from the bench, took off his robe, and bit the defendant on the nose. He pleaded no contest to state charges but was acquitted of federal charges of violating the defendant's civil rights. He spent five days in jail and was put on probation.

What a miserable state of affairs.
 
Step carefully judge. If you say 'Hey, this is reasonable filings!' You might put your toe in it.

I don't think there's any such thing as a slam dunk when judicial discretion is involved, and it is here. It's generally favorable to get a case to the arguments on merits rather than killing it based on failure to prosecute if the plaintiff has not abandoned the case but is just really stupid. If his father is actually dying or something, I wouldn't be surprised to see yet another allowance. The gears of justice grind (everyone) slowly since the court is salaried.

I think we're getting closer to greer running out of leeway, though, because of his latest tantrum. Nevertheless, I would not be surprised to see him served with a fairly stark warning before that happens.
 
The guy can file complete and total insanity, not move the case forward, swear at the opposing litigation and everything will be decided for him.

The court itself is skating on thin ice. Greer has blown off the requirement for what is basic practice for almost 4 years now, even going so far as to defy not one but TWO orders of the court to give Hardin the damn scheduling paperwork.

What's funny is this should not even be something that should be an issue. The Schedule is so benign it can be handled by Email. Literally the Plaintiff emails the defense and says "How does this look, does this work for you?" and the Defense goes "Yeah, for the most part, but we can't do such and such on this date" and the plaintiff then goes "okay, so, how does this date work?" and the defense goes "yeah. that's fine". And if there is quite literally an intractable issue both go to the judge and say they can't solve it so the judge solves it for them. But that is an extraordinary remedy.

This is so bizarre, because quite honestly Plaintiffs for the most part hate dragging things out. They want their justice and resolution. The idea that a Plaintiff would willfully prolong litigation over a scheduling conference is so far outside the realm of possibility that we are quite literally in wonderland. I think part of the reason the court is so "confused" in this messaging is because this is unprecedented. Greer is clearly engaging with his case, but he's not engaging with it correctly. Even after literally having his hand held and pointed to the basic bitch documents he has to sign.

Like literally, he could fill out the form in crayons, mail them in with random dates and that would be enough. Hardin could then parse the document out, do Greer's job for him and the court could accept the interpretation of the scribbles and set a schedule.

But Greer is literally incapable of even scribbling crayons onto a template form submission, and then has the audacity to spend pages cursing out the defense for harassing him over his inability to send them his scribbles.

The court has to do something soon, because activism has its limits and the judge is skating very close to becoming Greer's attorney. At which point a motion to recuse may be on the table from the defense. In fact if no sanctions come from this latest nonsense I think a motion to recuse on the ground the judge is acting as plaintiffs advocate should be brought foreword if only to preserve the issue for appeal.

Greer isn't as incredibly stupid as he looks, just almost.

He knows he's going to lose his ass on this case, so he keeps grasping at the straw that Null will take his "settlement deal."

It's literally his only hope, and given that he keeps falling back to it I suspect he has won some pro se cases via settlement because whomever he was suing just didn't give a fuck.

We have a pretty good idea of his lolsuit history and through that we know he has not won a single case; in at least two cases he's been forced to pay legal fees. I think his insistence on settlement is because he just doesn't want to deal with Hardin. Hardin has made Russ his legal bitch so many times, in so many ways, that Russ sees settlement as the only way to quickly end the case, get what he wants from Josh, and no longer have to be slapped around by Hardin.
