The statute is fairly clear. It's a misdemeanor to send a nude to someone. It gets to felony very easily by sharing it with multiple people or posting it somewhere.Also, related to Nick being a cuck, I doubt that anyone has been tried for revenge porn for sharing pictures with exactly one person through private communication channels. That might be the "fact pattern" issue that the DA has with this case.
That would criminalize a lot of behavior that people think is OK. Anyone texting an ex's dick pick to a friend now becomes "revenge porn" and if they talk about it on a twitch stream that adds "intent to harass." Sure buddy.
Agree the upgrade for harassment is bullshit.
Re the fact pattern, take your pick. Where is the photo? The harassment alleged seems thin and if you do look at the case law the harassment it covers is quite extreme. One case where some guy was posting his ex and exes daughter on Craigslist with their phone numbers.
Or maybe even someone being a possible witness in another felony being accused.
So, yeah, probably there isn't actually a case with no photo before and with someone claiming that pattern of harassment.
One thing is for sure. BalldoMan thinks it's a slam dunk on the felony so that means I wouldn't he surprised if the case is thrown out, as his legal takes are that bad.
