Virginia Juvenile and Domestic Relations Court case: JA010478-02-01 19.2-303.3 MISD VIOL COMMUN BASE PRBATION

C. Any sworn officer of a local community-based probation services agency established or operated pursuant to the Comprehensive Community Corrections Act for Local-Responsible Offenders (§ 9.1-173 et seq.) may seek a capias from any judicial officer for the arrest of any person on local community-based probation and under its supervision for (i) intractable behavior; (ii) refusal to comply with the terms and conditions imposed by the court; (iii) refusal to comply with the requirements of local community-based probation supervision established by the agency; or (iv) the commission of a new offense while on local community-based probation and under agency supervision. Upon arrest, the offender shall be brought for a hearing before the court of appropriate jurisdiction. After finding that the offender (a) exhibited intractable behavior as defined herein; (b) refused to comply with terms and conditions imposed by the court; (c) refused to comply with the requirements of local community-based probation supervision established by the agency; or (d) committed a new offense while on local community-based probation and under agency supervision, the court may revoke all or part of the suspended sentence and supervision, and commit the offender to serve whatever sentence was originally imposed or impose such other terms and conditions of probation as it deems appropriate or, in a case where the proceeding has been deferred, enter an adjudication of guilt and proceed as otherwise provided by law.

"Intractable behavior" is that behavior that, in the determination of the court, indicates an offender's unwillingness or inability to conform his behavior to that which is necessary for successful completion of local community-based probation or that the offender's behavior is so disruptive as to threaten the successful completion of the program by other participants.

While Austin is in "rehab", the Domestic Relations Court has finally caught up with the failed drug tests/bond violation, and have issued similar charges but for "Misdemeanor Violation of Community Based Probation".


This is in regards to his Domestic Violence case where he struck his father. Austin was given a sweet heart "First offender" deferred disposition deal where if he completed the 2 years probation the violent charge dropped from his record. If found guilty he is likely to be kicked from the program, and sentenced for the domestic violence charge. It is my understanding those kicked from the program usually face penalties on the higher end of the sentencing guidelines.

Offense date Friday, 9/13/2024, This was likely a missed or failed drug screen that broke the proverbial camels back.

Filed date 10/2/2024, but did not appear until last night in the system.

Next hearing 11/8/2024 for attorney appointment.

As its come up.. "How can he violate twice at the same time?" In Virginia they handle misdemeanor cases involving juveniles and domestic issues in what is called "Juvenile and Domestic Relations Court", or J&DR for short. Some people might call this "family court" as they also handle custody issues etc.

As Austin's arrest resulted in charges that span two different courts, each charge gets heard and handled in a separate court by separate judges. Think of it as two different jurisdictions.

Austin was out on BOND for his drug posession charge in District court. This bond required him to refrain from drugs etc and required testing. When Austin faild/missed enough tests, they revoked his bond. He's now in rehab.

Austin was out on a Deferred Disposition for his domestic violence charge in Juvenile and Domestic Relations Court. This deferral puts Austin into probation. As a first offender if he passed the probation requirements they would have dropped the charge at the end of the deferral time. This probation works like any other, and required refraining from drugs, meeting with a probation officer, and likely attending classes such as anger management and domestic violence awareness.

Though separate court jurisdictions, they were likely sharing the drug test results and just testing Austin once each week. When he failed the drug test he was failing it for both his bond and his probation.

Honestly I hope they cut him some slack in light of the fact he went to rehab, even if it's a joke of a rehab, before the consequences started arriving.
 
Austin has admitted on live stream that he was kicked out of the rehab, which was part of his current bond condition. This is about 9 days short of his ordered 30 day stay.
No updates in the court system yet, but all this happened on stream last night so the news may take a bit to get to them. He claims he has a meeting with his "PO" on Friday 18 October, 2024, but I dont know what result of that meeting could be other than turning himself in.

This is most likely going to result in his bond being revoked. He also has the probation violation hearing coming up for his domestic violence case, and he wont be able to use the rehab card there. We will see how lenient Virginia can be when that happens.

I can't imagine what he was doing to get kicked out of rehab. He's normally such a stable sane non violent individual with no impulse control issues whatsoever.

So what are the betting odds that on Friday it's "Go to jail. Go directly to jail. You do not collect $200"

I am dying to know what he did to get kicked out. Private Rehabs in particular have a pretty high threshold for BS. You would have to be belligerently uncooperative to get the boot
From what we know:
  • He claims to have had shouted DAMN THAT PUSSY NICE at an AA meeting after they made him feel some type of way
  • He said that he was taking a shit with headphones on and didn't hear someone asking if the toilet was occupied, so when they tried entering he slammed the door into their face
  • Has spent his entire time there buying expensive shit (Shoes, clothes, a fucking PS5 Elden Ring controller, etc), probably making the other patients feel some type of way
  • On one weekend he ordered a lot of pizza and chicken wings, most likely pissing off the staff as he disruptive them
  • During the one stream he managed to do someone asked him for money who he rejected, iirc laughing them off
  • The rehab probably had a never-ending flood of calls and emails about him
  • When he did that one stream he was screaming while gambling, being a nuisance
Additionally, in that stream some of the rehab patients shared their socials and one of them said yesterday that Bossman was hated there in the rehab, so it's no wonder that he got kicked out. There's definitely more stuff that we don't know of.

This isn't even a particularly strict rehab. It's a junkie-run rehab basically without professional staff. People can even leave on the weekends. It frankly sounds more like the kind of halfway house you go to after a rehab than a real rehab.

If he's in a mental health facility right now getting treatment, as is rumored, will the police pick him up there and bring him to jail when they execute the warrant?

Yes, i have a feeling it was the final soft touch for BMJ. With failing his parole terms so spectacularly, he's going to be forced to suck the long hard iron dick of justice.

What I am seriously worried about if he does go to jail for any length of time, is if he will be able to resist the non-stop (and often rigged) gambling inside and run up a debt he will have to pay off....one way or another. Cash, grass or ass as they say.

He may not get hard time. Maybe a few months in jail with work release. It's basically in custody "probation". Instead of getting sent up the river to prison for a few years you do 10 months in jail, they make you work as a dishwasher at a nearby resteraunt 40 hours a week and you attend the facility ""rehab"".

This of course assuming the judge believes bossman won't fuck that up too
