IMO Maher should probably try to remove to federal court under diversity jurisdiction, then argue Florida's anti-SLAPP statute applies under the Erie doctrine in the Eleventh Circuit, something that is currently unclear. Maybe that wouldn't be the best strategy for him but it would be fun to watch. Not sure if how i can link/insert/whatever to the pdf but i uploaded it too

She's a public figure and has to allege actual malice. Claiming a public figure had an adulterous affair is literally what New York Times v. Sullivan was about. It also has to be a statement of fact. Loomer cites one thing, and pastes it into every cause of action claimed. So $50k in legal fees and another $149,950,000 in reputational damage that prevents her from being an investigative journalist, getting her feelings hurt, and people thinking shes essentially an adulterous slur?
Maher sperging said:I think maybe Laura Loomer’s in an arranged relationship to affect the election because she’s very close to Trump. She's 31, looks like his type. We did an editorial here a few years ago ... it was basically, who's Trump fucking? Because I said, you know, it's not nobody. He’s been a dog for too long, and it’s not Melania. I think we may have our answer this week. I think it might be Laura Loomer.

I quoted exactly that in the very post you quoted. And no, there aren't any magic words that automatically immunize your speech, but in context, it's clear he's speculating. It's idle gossip. No reasonable person would view that as a statement of fact.Does "I think" and "maybe" keep it from being a statement of fact?
this is the full Maher quote for anyone else looking
Maher isn't going to settle shit. Neither is HBO unless they want to advertise themselves as a free pile of cash for any lunatic one of their people insults. She’s looking to pull a low 6 figure settlement out of this. She might even get 7, who knows.
Is it the 2014 reg date that’s right? No, the 2024 dateYes there are, and may, might and could be are those.
you just pulling that shit out of your ass
He's probably one of those illiterate dipshits who think "in Minecraft" means anything you just said is fine.Is it the 2014 reg date that’s right? No, the 2024 date
It is all in the context and what a reasonable person would believe hearing those words. There's a reason people use these words. "I heard a rumor" isn't going to do you much good if there's proof you were the one who made up that rumor. "Anonymous source said" isn't going to do you much good if you're the anonymous source. "Allegedly" isn't going to be some magical invocation of sphere of protection when you knew for a fact the person alleging it was an institutionalized schizophrenic you also knew was notorious for bizarre hallucinations.what about "i heard a rumor that.." "anonymous source said..." seem to hear those a lot..sorry to derail
"I'm not sure if they're fucking or not, I think I heard Bill Maher say they were on HBO though."what about "i heard a rumor that.." "anonymous source said..." seem to hear those a lot..sorry to derail
Link to article | ArchiveLaura Loomer is big mad at a new article about Trump (For brief context this is the one where its said he wanted to call Joe Biden a retard and dumped Laura because of her plastic surgery)
Cabinet? No.Is Trump gonna put her on some cabinet position?
BlueSky's office doors are in for a surprise this week.
