Humility is a matter of survival not just a matter of inner strength. If you're wrong, you're wrong, no amount of pride is going to change that shit and it's crazy that someone like Rekieta could've watched what happened to Ralph due to his own egotism and fall into the same damn trap. You have to be one particularly dumb motherfucker to watch someone get their life destroyed by some stupid mental shit and then do the exact same crap yourself.

You're right. However, in this instance, he explicitly gave permission to do this, and was adamant on this being okay. He could have copyright struck years ago, but never did.

Only now, when he's desperate and run out of options, he's falling back on his word and pulling the copyright card. While yes, he is in the legal right to do so, it makes him look WAY worse. Nothing about this makes him look good.

There's a reason a number of companies don't do stuff like this when it comes to YouTube videos that clearly don't have any editing at all, such as video game complete cutscene videos, video game soundtrack uploads, etc. Yes they would be in the right, but they know they would get shit on by everybody, and look terrible.

However, there is a case and ironically Nickhole covered it himself, where simply clipping with minimal commentary was so obviously fair use that the vexatious Greer-tier litigant who brought the case was ordered to pay the other side's costs.

It was Hughes v. Benjamin, 437 F. Supp. 3d 382 (S.D.N.Y. 2020).

So I hope Nick is prepared to get fucked up the ass yet again if he intends to drop a bunch of Benjamins into a case of this sort. Soygon of Assmad WON that case, bigtime, and the negress who brought the case got assfucked, huge.

Basically where I'm at. There's also other factors I'm thinking of. Not a lawyer, but they make sense to me.

A: the permission was written. That's a contract. Breaching a contract can be difficult.

B. He let his copyright lapse and go unprotected for years essentially by allowing clip channels to clip him. Copyright IS use it or lose it. That's one of its few weaknesses. If you don't defend it, it can backfire onto you and you lose your grasp on said copyright.
 
I think just having Null’s good/evil ceiling cats at the top of the screen with occasional speech bubbles encouraging or pleading against whatever Nick is saying would be low effort, funny, and actually add some valid commentary.
Nick's just gonna DMCA anyways and YouTube's copyright system is so busted that Elissa would have to fight it in court no matter what
