Cops throw a 'resisting arrest' charge on if you so much as say 'wait a minute, what?' And will chant 'stop resisting, stop resisting' no matter if you follow their every command to the dot, it's fucking redic. But judges know this and unless it's 'resisting with violence' backed up by video evidence I don't think it factors too hard in the average case.
Yes...but. This is in a situation with a second time felon, on probation. Leniency on these things are given to retards new to the system. Not to retards that are the systems bitch. The fact that they have not accepted their bitch status counts against them. A bitch that doesn't learn from a smack gets a beating.
 
How might these new charges affect that probation and the 5 years he still has hanging over his head?
This is my question too. It hasn't been 10 years so his suspended sentence is basically on lock now right?

This is my personal opinion on the matter. Bossman said he's ok, the judge has to help Bossman fulfill his promise to us that we are ok. It'd be criminal to deprive a man such as Bossman his Big Buford, I think it's in the constitution or something. Evil Eddie's influence hangs over the court and they may hold onto him for a week or two to try and appease the negative spirits conducting warfare as we speak.

Based on energy readings around the court, he'll be held until at least the 8th of November, which is a busy day with a lot of hearings stacked up. This new assault & battery case has been already continued until the 21st of February and its next hearing type listed as ADJUDICATORY which from reading appears to be fancy law speak for a trial https://law.lis.virginia.gov/admincode/title12/agency5/chapter462/section240/

I think what's best for Bossman is he stays in jail for a few months since the stacked up time can be used to knock out a bunch of his cases later on as part of a package deal. With a few months served, you'd easily be able to dispose with time served everything except the felony drug charge with no bullshit probations. It's unlikely Bossman will collect new charges in jail as he's incredibly meek and only capable of hitting his parents/brother. I don't think he's going away for years since if they were the sort of people to do that, he wouldn't have gotten all these lifelines already.

The felony drug charge will be a little more difficult, he may have to spend a few more months after sentencing or go to a proper inpatient rehab. At this point I doubt there's any desire from the judge to do any further outside supervision, so he'll probably be sitting in jail until everything is resolved. Regarding that 10 years hanging over his head, I'm a true believer in lol cow immunity to all consequences and I think they'll just let it run its course unless some outside pressure forces that county to do something. (media, victims complaining, etc.)

What'll be interesting is once he is finally out, how long will it take until he hits the crackarooski again? I'm thinking it'll take <24 hours and I hope he decides to livestream it. A content oasis awaits us if we're just patient enough.

It depends entirely on his strength of will, which we have a fairly accurate measure of. But it also depends on the strength of the love and support his family gives him. Which we also know the strength of. The third biggest variable is how meaningfully he engages with his rehabilitation and the systems of support upon release. If he goes right back to his room with mom coddling him, he will essentially have made little progress and that can be extremely deflating even in the face of tasting freedom, so your instinct as an addict is to reach for a pick me up and maybe game a little. Then another. And another.

Boss' hope post release is dependent on everyone involved learning very painful lessons. Boss has to accept he is weak-willed, not a gangster, and his default mode is pleasure seeking and so must learn to avoid activities that will snowball into a spiral. Dad must grow a spine, a lot of this could have be avoided if his retarded brat was dealt with in a stern, but loving manner. He may still have turned out a bad egg, but this got so out of hand that the government had to come lock him away. Multiple times. And mom. Poor mom. I get it. I have an Austin in my life. You think you can save him. You think that by reducing his avenues to commit crimes and by keeping him under your loving, watchful gaze you can protect him from himself. You think that if you take him to his crack dealer, that if he uses at home and make sure he's fed, clothed and shelter he won't just up and die in some God forsaken gutter. You hope these lesser evils will help him come to his senses, you hope your little man is still in there, you just have to find the right way to reach him, the right words, the right key to his lock. I'm sorry, mom. I really am. This was the best possible outcome for your boy for the trajectory he was on. Grieve. Learn. Be ready when he comes out.

There was no hearing.

The county is so small, they only had 3 people on the docket. One was as speeding ticket, the other a trial for an animal seizure for a guy who had sick/unfed cows etc. They canceled Austin. A note must have gone out to his attorney and rat dad as neither of them were there. as of 850AM before I went into the courthouse it was not continued.

It usually doesn't factor in, but once a cop has told you that you're under arrest there's nothing you can say or do at that point to change their minds. At the point your best bet it is to comply and shut the fuck up (if you haven't done so already) and let your lawyer sort it out later. The cops will appreciate not having to deal with someone acting like a toddler and your boring arrest video won't end up with millions of views on some YouTube channel that makes their money showing adults acting like complete children instead of going peacefully.

I'm sure that some of those channels are already trying to get any body cam footage that might exist. Bossman has enough internet notoriety that it will definitely get views even if it's not up to their typical tard-rage levels of antics. There's also plenty of other footage of him being a crackhead that can be used for b-roll if they wanted to make a longer video.

And that's why the vast majority of a criminal defense lawyer's job is walking clients through the system and telling them to take the plea deal.

18.2-250. Possession of controlled substances unlawful. Class 5 Felony 12 Months (if Misdemeanor conviction) 1-10 years if felony

18.2-460. Obstructing justice; resisting arrest; fleeing from a law-enforcement officer Class 1 Misdemeanor 12 Months

46.2-817. Disregarding signal by law-enforcement officer to stop; eluding police; Class 3 Misdemeanor $500 Fine

Theoretical maximum 13 years. Likely maximum 4 years. Realistic sentence 6 months + probation (in my guestimations)

Don't forget the failed probation conditions for his prior convictions.
 
So 18 years max, probably 6 months to one year realistically, depending on whether or not Boss can keep his nose clean after being inside so long.
The longer he's in, the more shit he's likely to stir up.

After the court stiffed us for the 10/29 hearings and rescheduled things for 11/14..It looks like the clerk has really redeemed herself and moved ALL of Austins District Court hearings into one day on November 7, instead of some being November 7 and some November 14.
It looks like they actually want to resolve all this bullshit in one go instead of diddling around endlessly like Virginia seems to prefer to do.

So either we're totally felted or it's gonna squirt real hard soon.

Good, so now the court can can free our boy in one go. Justice for Bossman, he dindu nuffin.

BossmanJack's appearance in court this morning was a quick one.
While being lead into the court in his orange jumpsuit and shackles with the other prisoners, Austin scanned the court room, searching for his Father, Mother, or any kind of support. Though he searched desperately he found none. Not even his Lawyer was present for his hearing.

Austin looked very gaunt, with his former "fade" haircut grown out but not yet wild like before, with a pube-beard growth of not shaving for 2 weeks. Though other prisoners had no issue walking into the court room, Austin seemed to struggle under the weight of the handcuffs he was in, shoulders deeply hunched under their weight, making his 6 foot frame nearly 4 inches shorter. He looked as if he hadnt eaten in a week, not slept in twice as long.

When the judge called his case, Austin shuffled up to the stand, again scouring the courtroom for anyone who was there to help him. He truely seemed as if he didnt know no one would be showing up. When greeted by the judge he responded so meekly the judge repeated himself.

The judge then stated that the case would be moved one week to November 14 when his attorney would be available. What seemed like a summarily given scheduling matter hit Austin by utter surprise. When the Bailiff grabbed Austin's arm and gently pulled to escort him back to holding, he blurted out "I'm not getting a bond?".

The judges simple reply "No. No bond." Austin was then taken back to holding. No reading of charges, no updated details etc.

Holy shit, bossman's world must have shattered at that very second. reality is settling in.
