Let's say the worst case for Aaron is the prosecution has that naked photo and Geno testifies Aaron sent it and the prosecutor insists on going for the felony.And then what? What does that get you?
Nothing. It is completely irrelevant for the actual charge.
I imagine at that settlement conference a tactic Aaron's lawyer is going to use is to introduce all the debauchery. An avenue open can be to say his understanding was that the photos could be shared. To boost the credibility there he could say Nick and Kayla are swingers and engage in exhibitionism. Aaron could say Kayla had no problem with him showing the images to other people. You at least introduce the doubt to a jury by introducing all the debauchery and suggest the real motive is not Aaron didn't have a reason to share the photos, but that it is all attempt to get revenge or engage it witness intimidation against Aaron, who is a potential witness against them in a drugs felony case.
Introduce all that stuff to a jury, backed up my text messages to boost Aaron's credibility on the exhibitionism claims, I wouldn't be surprised of the prosecutor decides in advance this isn't a case she wants to put in front of a jury and if she does, there is a realistic chance some jurors will believe Aaron. Having it in black and white they like to be naked can swing that.
