Let's say the worst case for Aaron is the prosecution has that naked photo and Geno testifies Aaron sent it and the prosecutor insists on going for the felony.

I imagine at that settlement conference a tactic Aaron's lawyer is going to use is to introduce all the debauchery. An avenue open can be to say his understanding was that the photos could be shared. To boost the credibility there he could say Nick and Kayla are swingers and engage in exhibitionism. Aaron could say Kayla had no problem with him showing the images to other people. You at least introduce the doubt to a jury by introducing all the debauchery and suggest the real motive is not Aaron didn't have a reason to share the photos, but that it is all attempt to get revenge or engage it witness intimidation against Aaron, who is a potential witness against them in a drugs felony case.

Introduce all that stuff to a jury, backed up my text messages to boost Aaron's credibility on the exhibitionism claims, I wouldn't be surprised of the prosecutor decides in advance this isn't a case she wants to put in front of a jury and if she does, there is a realistic chance some jurors will believe Aaron. Having it in black and white they like to be naked can swing that.

I personally don't even think it goes to trial and the worst case for Aaron is a misdemeanor. If Geno won't testify and they can't get that multi media message then I imagine it gets dropped completely .

Yet messages floating around of Nick saying they are essentially exhibitionists has to be at least useful.

Seriously this extremely expansive interpretation would mean you could somehow force an agreement to privacy on someone by harassing them with nonconsensual dick pics and they couldn't do anything about it. That's sovereign citizen level of "if you don't respond you agree to the contract" levels of nonsense.

I'm not disagreeing the statute is written in a way it could be interpreted that way, I just think it's nonsensical and contrary to basic principles of due process to do it that way.

I think that is exactly how the statute for the misdemeanor is written on its surface, sending non-consensual dick pics in itself is harassment, so I think its a different topic and situation.

But that is all just for the misdemeanor. Aaron being part of a group chat in which it was shared means it was a closed group, not general public. So the expectation should be automatic that it stays within that group even without written consent by all participants.

For the felony charge it is an entirely different thing, because that would require a history of harassment targeted at Kayla and they simply do not have that. The 1st Amendment is expansive enough to cover everything Aaron said on air about the Crakietas. So that felony will be dropped for sure.

The problem is that this idiot Aaron keeps talking about the farms on his stupid fucking show like we are his personal army.
