According to our favorite Gap Toothed blogger, we should ignore the fact that the GOP just ran a clean sweep of all three branches of government including the popular vote by focusing on rolling back troonery. INSTEAD, we should focus on purple seats in state lagislatures that just happened to go blue this cyle.

As I got to the end, I noticed that Dobbs was only cited eleven times, not twenty one times. The last time it appears, it's in the title of a law review article that was discussing Dobbs. The other nine times Tony is counting are where the court is just speaking about what happened in the case and refers to its name, not citing to the case for any quote, legal concept, or holding. That means Tony literally ctrl+f'd "Dobbs" and didn't even look at what was being written. He just saw "21" appear on his screen and thought that he could look smart by tweeting about it.

What a fucking retard. He should stick to gooning and stay out of law.

The legislators fucked up something fierce by using an undefined, meaningless term like "gender" instead of "sex".

I guess they didn't realize the risk in 2005.

Older legislation like Title IX does properly use sex, which is going to absolutely shred the troon arguments in court. But the RealID gender gibberish is going to be unnecessarily difficult.

Dobbs detsroys the troon argument on multiple fronts.

1. First, it reaffirms Glucksberg which requires 14th amendment substantive due process (fundamanetal rights) claims to be "deeply rooted in the history and traditions of the United States. There is no way troonery can meet that standard.
2. Second, even if Kate Strangio is right and the troon bans are "sex based discrimination," so what!. A post Dobbs equal protection claim invoking sex based discrimination in medical care requires affirmative proof that the regulation is a mere pretext for unlawful discrimination. The troones cannot overcome this hurdle in the current supreme court case.

"The regulation of a medical procedure that only one sex can undergo does not trigger heightened constitutional scrutiny unless the regulation is a “mere pretex[t] designed to effect an invidious discrimination against members of one sex or the other.” Dobbs v. Jackson Women's Health Organization (2022) 597 U.S. 215, 236

His logic is far far stupider. Moderates would lose because those are the seats most likely to flip to the other party in all instances, hence why they're held by moderates in the first place. The safe seat legislators can take any stance they want without losing because their voters aren't going to vote Republican in the general. Tony's "evidence" just as much supports that the legislators were turned out for voting "against all the other anti-trans bills" because they're now replaced with Republicans who will not do that.

It's not evidence that "you can't negotiate a middle ground" it's evidence that they didn't go far enough to find it.
