Last question first, you can't really raise your rates, but you can ask for a huge advance deposit based on thinking the client is going to prison and will be unavailable/unable to pay. Going to depend on his fee agreement.

Id be pretty confident against Nick because he is so blatant about everything he does that even if he cheats to win a battle he's going to loose the war by leaving a paper trail.
They're going to have a way easier time getting the current stuff in if Nick gets convicted first. The fight will be about relevance and if it's more probative than prejudicial. This is an area that's going to get really deep into local rules and practice and will depend on a lot of stuff. Reputation is almost certainly at issue in that trial, (as a general rule you can't just character assassinate people in court) and I expect you could show Nick has a reputation for untruth or whatever the local standard is to being able to call somebody a lieing liar who lies.

If it were me I'd be fighting hard to see his trust documents so I can figure out if I'll be able to collect that way or not. If so I'd be tempted to continue stuff to see if he gets convicted of witness tampering or wiretapping. You could definitely go after his honesty with that.
