Nick's lawyers suck so fucking bad.
Ok but what are they supposed to do? Their client is obviously guilty. He obviously was on coke, he obviously possessed the coke and other drugs, he was obviously neglecting his children, his children were obviously stinky and hungry, his 9 year old was obviously on cocaine. His lawyer has seen the bodycam footage, he knows the house was a horrorshow. He knows his family, church and community reported him and knew he was driving around drunk and high all the time.

On top of that you have this wet-brained retard who calls himself the Law Pope but has never been in a court room or has won a case and he's telling you what to write and what to defense to put up. And he's your client who's paying you, so you technically have to do what he says.

I don't see how you can come down so hard on the lawyers here.

I'm 100% sure Nick is screwing with his own defense.

Without going into specifics, I was in a situation where it was unclear if I'd face legal consequences when I had to report an illegal activity. I have more knowledge of the law than the average bear. I'm certain my lawyers wanted to kill me by the end of every meeting because I was constantly asking, "why doesn't this law apply?" and, "I don't understand why you want me to take this course of action when my understanding is that x should follow." The thing that separated me from Nick was that I agreed to trust and follow my lawyer's advice, even if I didn't understand it or think it best. When I challenged my attorneys, they usually said, "we could do it the way you're describing, but we strongly advise against it." I'd bet money that Nick said, "we'll do it my way." Much to his detriment. Hence the bullshit motions he's filing and the terrible arguments.

From my experience, the other intensely difficult thing was not wrangling the other witnesses to say and do things. It's exceedingly tempting to want to call others, "agree on a story," plan what to say and not to say, etc. It's terrifying relinquishing that control to let things play out as they should. Inaction is so much harder than action. The same is true for fighting the desire to do damage control when your otherwise sterling reputation is getting shredded.

Suffice it to say, listening to my lawyers kept me in very good stead. Nick is a cautionary tale of what happens when you don't shut up and take the advice of paid professionals.

I think this a strawman argument. Neither of the 3 things you listed are why they are shit. They could have filed for a Frank's hearing and an interlocutory appeal without being shit.

In the omnibus, they failed to raise other more basic concerns of probable cause. Also, their August filing was less coherent than future filings. This reduced their ability to make an argument about the issue they wanted to raise. They bogged themselves down in watermarks and differences in the stream that wasn't material to their argument. They were all over the place.

In the interlocutory appeal, they failed to state why the appellate court needed to intervene.

The issue wasn't necessarily the course of action, it was the execution. And both the Frank's hearing and appeal were longshots but they could have done much better, particularly the other basic challenges in the omnibus. They could have filed everything Nick wanted to file and then make coherent legal arguments that covers everything their client needs.

It isn't just the general strategy that was bad but the specific execution. Barneswalker basically left shit on the floor. Like focusing on the unlikely Franks motion while utterly failing to raise the very basic probable cause issue, causing Judge Wentzell to sneer contemptuously that he'd effectively waived the issue by failing to raise it at the hearing.

The sole mention of probable cause was in a single line and there was no followup. This was arguably malpractice. Even if Nick has general control about how the representation should go, what arguments should be made, and how they should be made, unless Barneswalker was specifically told not even to raise the argument, he was still obligated to uphold an objective standard of competence.

Even the (obviously doomed) petition for interlocutory review failed to make the actual argument other than in a nearly throwaway sentence that didn't even raise the issue of why in particular the unresolved nature of what would make a recording of a livestream unreliable was actually important to the central issue, that being why it needed immediate reviedw. That, similarly, was objectively incompetent.

Nick has the right to ask his lawyer to make dumb arguments, but there's still an objective professional standard a lawyer is supposed to uphold.

The main reason it probably doesn't constitute actionable malpractice is Nick would have lost anyway. It's more that it's just EMBARRASSING.

I’m trying to remember exactly what had happened that likely set Nick off. I remember Nick saying something about “someone else talking, so now he could discuss certain things,” a short while before he made all the super failures of the last few weeks. There was the Kayla omnibus failures, with the amazing pic of Dark Energy Nick & the lady, K, who attended the omnibus & was harassed by Nick. Then he fail streamed that first cooking thing, shaking & staged. Total flop. It’s also known he was late to Kayla’s omnibus thing.

Then Nick called in to PaedoMelt’s show drunk as fuck, possibly high, slurring uncontrollably. And right before that call he’d leaked the old Aaron browser stuff (from around the 5k pages of this thread, dating back to June or July.) Nick seemed to have a little help with that homosexual maneuver from Juju & “friends” who helped Nick try to spin that to hurt Aaron. Plus his super out of control posts on X the last few weeks were especially spiraling.

Best I can think is something to do with Aaron shutting Nicks illegal access down some weeks back? From the message dates on PaedoMelts discord room, (shared ITT not too long ago,) Nicks access was removed in mid September, iirc. Pretty sure it was on 9/11, & I remember that weird Locals message Nick posted that day about being able to speak finally, iirc. Then Nick went into a manic meltdown & let more & more craziness spill, some while clearly fucked up & due to the choice in who he shared it with like Melton, who prematurely gloated & tattled on Nick. Nick also gloated, by posting the alleged Aaron screenshots, implicating himself. That doesn’t come across as a sober action. Guess the jury is out on what substances Nick is abusing, & to what degree a manic episode is playing a part. His mania is seemingly in the drivers seat when he’s on X or other social media or streams these days & he’s appeared intoxicated at least once, on that call in show.

Rumor is (according to Andy Warski) that Balldo's last mandated drug test was about two weeks ago, and he immediately got drunk and high afterwards. Warski says that he has this from "a very reliable source," so take it with a mountain of salt.

It happens more than I would have ever imagined, and IANAL. I’ve had a front row seat for a multi-year legal battle where that’s exactly what several of the defendant’s lawyers have done (he’s torn through a dozen legal teams). One of the lawyers in particular has received a great deal of acclaim for his work on a major presidential scandal, is a Yale Law professor, etc. Yet he still let his absolute lunatic client write filings and signed his name to them. He also filed a false (but unsworn) affidavit claiming he submitted discovery items that were never turned over. There have heretofore been zero consequences for him.

If I hadn’t seen it myself, I wouldn’t have believed it. I’ve learned not to have any expectations of the legal system except disgrace.

Nick is pedaling as hard as he can to get away from his daughter’s drug tests. Yet he still refuses to answer how many tests she was subjected to and whether the results invalidated or affirmed the original positive result.

Warski hasn't been missing much lately so I'm inclined to believe it. Especially since he seemed to get even crazier in the last two weeks.

Nick has called all of the lawyers who've represented the polycule in the criminal and CHIPS cases incompetent. Failure to state a cause is Melinda Scott tier shit, but Nick is a lawyer himself and should have picked that up before the document was submitted to the court.

It almost seems like he's intentionally setting things up so that he can claim ineffective counsel when he loses.
