The Motion in Limine, which is a a pretrial motion that seeks the exclusion of specific evidence or arguments from being presented during a trial, wasn't available for download.


I'm not sure if this has been mentioned, but Judge Crane will be retiring in January. I assume he's not going to have much patience for Dave's bullshit.

Holy Shit! He’s really doing it! Dave’s trying to include recordings of his dad SCREAMING at him. When it literally has nothing to do with Dave’s criminal charges for putting it on the Muscato account.
What kind of defense attorney is allowing him to do this?

The evidence referenced in the motion for continuance was admitted by the State, not Dave. Dave's lawyer was asking for additional time to review said evidence since they were made aware of it recently by way of discovery. Someone can correct me if I'm wrong, but that was how I read it.

Imagine the treasure trove of Joe Muscato home videos where the princess speaks of her entitlement to the parental home and funds.

It's incredible to think of the kinds of text messages Dave must have sent to his folks. He's so grandiose that I'm sure he bragged about spending their money at the country club. I wonder if they have specific recordings telling him not to do that and he said he'd do it anyway. He's literally that fucking stupid.

Some of the things I'm curious about are (1) whether there's any evidence (say, text messages) of Dave threatening to report Joe for child porn possession (I want to say that was the threat made at the dentist's office, to Mary); (2) any evidence of Dave "hacking" (or simply logging) into the family's calendars et al. What they've pulled from Dave's social media (say, the livestream from the day he got arrested in their neighborhood for busking or the incident at the therapist's office). And how much stuff we don't know about.

I'm not necessarily surprised this hasn't made a splash in the local media, but it would seem with the semester coming to an end, it would at least be something to talk about.

I'm almost certain there are. Unless I'm misremembering, text message screenshots by Dave have actually been posted online of him sending messages to his mother about this and him threatening to go to the FBI if they didn't give him money.

I don't think he realizes that whole "give me $10,000" thing he did, the way it is written, literally comes across as something someone holding a gun to someone's head would say. 'I'm doing this to test if you can follow instructions' I mean, Jesus. Sounds like something out of a fucking gangster movie.

Buddy, he's got all the awards you pay for to hang on the wall! He's gotta be 11/10.

Seriously though, I'm sure he is going to give Dave a legally sufficient defense at his trial (that he is desperately trying to postpone) and will do as good of a job as anyone can at arguing for probation when sentencing comes.

Dave is a first time offender and he's likely eligible for Jury sentencing. He should defiantly waive that. If he's sentenced by the judge I'm predicting 120 day "treatment program" in state prison, 5 years probation on a 7 year sentence, more special conditions than you can imagine and he walks away as a convicted felon (he could theoretically be sentenced to a different kind of probation that wouldn't result in a felony conviction if he completed it). If the jury does it he's going to prison.

there is no way dave will enjoy prison off of this. i could list all the factors why but i'm too lazy disabled right now. i think trial will be entertaining but let's be realistic.

I'm pretty doubtful our lovely lady Danielle will see any jail time.

It is only a non violent crime under 1,000 dollars I'd guess probation for 5 years and a order to stay away from him parents. don't get me wrong I'd kill to see Dave sent to jail for all the shit he pulled but I'm guessing his lawyer won't allow the state to being up all the harassment shit as it probably not relevant to the dine and dash.

I mean unless the state can somehow tie it to the dine and dash crime. say that it was part of his plan to ruin his parents reputation in the community etc etc

Remember he's been charged with stalking and harassment as well as theft so a lot of his bullshit could be on the table.
