It sounds like what you really want is a "Department of Educational Standards" that would work to guarantee baseline level of education in all federally funded schools. That is NOT what the DoE does, and if you want a department to do that, you should get rid of the current DoE and create that one. You are going against the well developed entity as it stands to try and make it, and it will be challenging to go against the "DNA" of the organization to make it do that.
The Department of Education was created by Andrew Johnson, but was basically useless until Jimmy Carter made it a cabinet-level bureau. The Charles Kushner case is a similar story where he served time before receiving a presidential pardon.
