Well, yes. The pre-foreclosure notice is not particularly detailed. But it is a notice. And it came on top of months and months of mailings from the mortgagee. Any claim that Rackets had no idea he was cruising for a foreclosure seems unsupported.

The actual notice of foreclosure also doesn't include the reinstatement amount. That is because that amount changes daily. To reinstate, a mortgagor needs to contact the attorney for the mortgagee and get the exact amount.

It may very well be the case that Rackets will redeem the property after the sheriffs sale with the proceeds of the sale of the extra house. But from our perspective, that is speculative. Our evidence that there is even an offer on the Silent Hill house is very slight.

What strikes me as especially foolish on the part of Rackets (aside from taking out a $300,000 loan) is that he chose to secure it with a mortgage on his family residence when he had an entire other property to secure it. He could have mortgaged Silent Hill House. There is something especially funny and weird going on with this entire transaction.

You’re both assuming that there isn’t some other giant hole: Whether Randaza, some dope dealer or something else entirely, that is going to suck up the proceeds of that sale.

I wouldn't be so sure. At this point I'd be shocked if Rekieta had not ruined his finances to the extent that a $350k-ish injection of cash is unable to repair it.

There's a couple other things, like the fact that he appeared to also stop paying his property taxes (his dad had to pay for the spare home) and failed to maintain insurance or registration for his vehicles for up to a year or more, which make it seem possible that he thinks he can just stay in the house without paying.

There's also the possibility that Rekieta WANTS the house foreclosed because he is trying to get rid of any ties he has with Minnesota as some sort of 4D chess move which will fail.
