That is technically against the law. But they would likely not go after him for it unless he tried to claim homestead status for two houses at the same time. Its also stupid on his part because he gets the tax benefits of the homestead on the property taxes of the house of lesser value (and a lesser amount of property taxes to pay). They wouldn't go after him because he is only hurting himself by doing it.

If he tried to claim any potential state income tax benefits around the second house being his homestead for purposes of the sale, that would IMO be tax fraud. The state might not notice, but then again it might.
