I can't wait to hear about everything that has been going on in the background between Hardin and Russhole, and I hope we won't have to wait too terribly long before we start getting that info.

There is another reason why the judge may not be inclined to dismiss the suit right now that has nothing to do with humoring God's favorite retard. In one of his filings, Hardin remarked that because of Russ' dishonesty about the witnesses, etc., discovery for the defendant was now going to need to look into issues relating to possible counter-suits for malicious prosecution (I forget the exact details). The judge may be looking at the situation and thinking that both sides now have reasons for the case to continue. Ending the case now would end Josh's chance to look further into Russ' malfeasance (short of filing a new case).

Youd think if the defense was interested in pursuing this however they wouldn't be asking the judge to throw out the case.

i was watching potentially criminal's stream, and maybe it was because he kept inferring that jurisdiction may still be an issue, but i noticed something that i missed before.

in his recent reee!sponse to mr. hardin's motion for an extension (ecf 212), greer states, "regarding personal jurisdiction. This has already been litigated, which is what caused the case to be retransferred from Florida."

but that's not true. the decision was not vacated because "Moon [ ... ] has been purposefully directing their activities in Utah", nor because "The infringement occurred when plaintiff was living in Utah".

as previously posted, and acknowledged by both the defense and the court, greer lied. he presented previously undisclosed witnesses in his motion to retransfer venue (the heavily cited ecf 123 at 15), which mr. hardin had no opportunity to investigate, and when florida returned the case for the utah court to reconsider its transfer decision, this magistrate judge agreed that utah had jurisdiction solely on the basis of greer's lies:

imagine the sheer fucking audacity to lie to two separate district courts, to have a magistrate judge overturn his own decision on the basis of those lies, and then to lie to the very same magistrate judge again about why he overturned his own decision!!

i'm grateful that the judge is finally acknowledging greer's fuckery and i'm firmly in support of the notion that he is giving greer enough rope with which to hang himself.
