I forsee the court taking pity on russ that he didn't know Steve was dead when he invoked his name in Florida and then never disclosed him or even mentioned him even though Russ likely thought he was alive and just wanted to use him as a undo the thing that happened card.

One instance of many, however Russ can largely gloss over these by saying the magical incantation.

Obviously the pronunciation will be off and there'll be a significant amount of drool, but he's got the spirit of it despite being a vexatious litigant that studied* law for a significant period of time.

*I use 'studied' extremely liberally here.
 
Invoking a person who is dead or otherwise not in contact as so important that it requires an extraordinary transfer of forum is so beyond the pale that I would seriously consider bringing it up to the court as worthy of sanctions. It really does approach fraud on the court.
Greer merely needs to bring his Ouija board and a medium to the court to contact the spirit of Steve, who can procede to tell the judge “oh yeah Russ used to complain about how much that site annoys him.” The judge will immediately rule that his copyright has been infringed and award a million dollars.
 
Well now Hardin's motion is moot, cus he's dead and Russell misspoke when he said "Falling out". No harm was done, and in fact because the witness died after hearing of the harassment of the evil Kiwi Farms, a website, his missing testimony must be interpreted and accepted as favorable towards the prosecution. Furthermore, him being dead proves beyond all doubt the witness' inability to travel to Florida and the rightful return of venue to Utah.

Therefore the court shall order sanctions upon the Hardship and a website, as well as ordering Emily Willis into the care, marriage, and employment of Russel Greer and Intimate Dealings LLC
 
The Steve business is imo the same deal as later when Russ added his brother and father as witnesses. Remember how he added them without telling them, and they were surprised when Hardin reached out, which led to Greer panicking and witness tampering? I think he added Steve as a witness without reaching out or even checking if Steve was alive first, not realizing (or not caring) that you need a witnesses' consent first.

I think this is exactly what happened. Russ named his father and brother based on phone calls/text messages from 2021-2022. I bet Russ told Steve about KF in the same time frame, assumed that was good enough to call him a witness, and hadn't spoken to him since. The asshole who can't be bothered to tell his own family that he's naming them as witnesses, certainly can't be bothered to keep in touch with a "friend" 2-3 years after plightsplaining to him.

Also, I'm... meh... by Hardin challenging such a flagrant infraction like lying about a named "eager witness" based in Utah burying it at the end of a motion for what I understand is something else entirely (adverse interwhatever); maybe it's common practice and hopefully the Court doesn't see it unfavorably.

For people with experience with the US judicial system: what would be the best venue to seek remedy for the actual lie of having "Eager Witnesses": because technically Russtard lied to Nevada Florida no? Not Utah where the issue is being raised.

He could be sanctioned for further attorneys fees to make up for Hardin having to spend additional time unraveling his bullshit at least.

Russel lives in Nevada now but the case was started in Utah and has been there the whole time outside of the brief transfer to Florida.

Russ lied directly to the Utah/Florida when he said he witnesses that were "eager" to testify, when it turns out he never spoke to any of them about testifying and at least one appears to have been fuckin dead at the time. Plus he alluded to having more witnesses than the two he directly named in his "motion to undo the thing that just happened and transfer back to Utah". Which I guess he just meant his brother and no one else.

Yeah sorry I wrote the wrong state, I meant: he lied to a Florida court.
Because I was worried Utah could just say "He didn't lie to us so no jurisdiction fuck off or whatever".
