I'm just not sure how the court would draw a reasonable adverse inference beyond that which it can already draw from Russ's own many dumb statements- there's so little known about what this witness would talk about that it's almost as if he doesn't exist.

Would be fun if he had to actually produce this allegedly totally-real person. Probably only to find out that "well, the gist of it is that he's not one person, he's like three or four people that I combined together for simplicity, but I don't have their numbers anymore and I only knew them by nicknames and they're all in canada and refuse to contact me for fear of getting their cars immolated by mexican gangs working for kiwifarms"

That aside I doubt this will do anything useful. The court wants to get this show on the road with whatever russ can actually deliver (not much, as it turns out).

Also of note is that last paragraph:
There are more witnesses that would be called and summoned for trial, who DO NOT LIVE IN FLORIDA, and so a venue transfer to Nevada would be easier for the witnesses to get to, as Nevada is only a 6 hour drive from Utah or a short flight, whereas Florida requires flying from the Rocky Mountain states.
Note "witnesses", plural, and that they supposedly live in Utah. These are witnesses beyond the already named Steve Taylor and Russel Greer's father. It is unlikely to be his Russ's brother, as Russ's brother was in Texas. So just who are these other witnesses in Utah that Greer was planning on calling to testify at trial? His imaginary friends? The shadow demons who torment him in his dreams?

One thing interesting of note about this motion and these shenanigans from Greer. No court really wants to be responsible for this case. Not Florida and certainly not Utah. That soreness over the case being retransferred could be enough to push the scales in Hardin's favor.

Interesting to see Hardin make the process is the punishment be utilized on the court rather than simply on the parties.

Being forced to take Greer seriously is a form of torture that should be banned via the Geneva Convention.
I don't think it's too much to ask for some carefulness and being able to put two and two together.

He attended LDS Business College which is now Ensign College, so it's the right school but still the wrong guy.

I don't think so just cause he died in January and Russell was listing him as a potential witness when arguing the case should be moved back to Utah in like March/April.

So if that were the guy then either Greer knew he was dead and was just using the name or Greer never checked in with Steve and presumably hasn't checked since then since his given reason for not calling him is he had "a falling out" with Steve Taylor and not "Steve Taylor is fuckin dead and can't testify no more".

I did see at least two Steve Taylors at the college Greer went to for his paralegal degree, LDS Business College which is now Ensign College.


More likely it's the one that manages the cafe, if Greer actually spoke to anyone.

Though reading further, the bio in that speech says this one was manager, so I think it's just one Steve Taylor, directory might not have updated to his new title or something.

I just love how Russ always accuses others of his own errors and sins**. Sanctionable behavior, delay, recalcitrance, paper deluge.... Here, he sneers at Defendants, suggesting their "vague" reference to witnesses "leads one to believe there are no witnesses."

Definitely the same guy. I don't think it's beyond Greer to list a guy that was dead as a witness and now lie about why they can't testify to try and save whatever face he thinks he has with the court.

I wonder if the directory for Ensign just hasn't removed this Steve Taylor for some reason, would be weird for there to be two that both were food managers. From the obituary it says Steve Taylor was the food/Cafe manager until they gave him a new role when the college's name changed.

I actually love and appreciate your consistently correct usage of the word "hoist" in this context.

Nevertheless, I humbly offer the suggestion that "hoist with his own retard" fits our boy more fully.

Of course he will, but I meant the sanctions Hardin has shown to Greer but hasn't filed yet:
A prerequisite for FRCP 11 sanctions is informing the other party of what the offending filing is and to give them an opportunity to withdraw that filing. If Russhole fails to withdraw his frivolous filing, he is subject to additional sanctions.
I thought that was what was just filed.
No, he's notified Russ of it. And the email is enclosed to inform the court of a Rule 11 letter. It didn't have to include a drafted motion, but that shows that a motion WILL be filed if Russhole doesn't desist from his doomed course of action that will put him in debt for the rest of his miserable, drooling, ratfaced life.

He has, so far as I know, not yet filed the actual motion, because Russhole has a narrow window of time to save himself from the doom he has brought upon himself.
