I think its somewhat unlikely that they have the photo from that source. Just because of how the phone providers operate. They may have "A" photo from some source. But they will ultimately likely be depending on Geno's testimony to link the particular photo to Aaron.
But I think they would also be willing to proceed with the case even if they have no photo to present as evidence at all. Its a more difficult case without a photo, but not an impossible case if Geno confirms the contents of the photo he was sent are (a) Kayla and (b) match the requirements of the revenge porn law.
I think without the photo its a bad case for a prosecutor to bring to court, but not an impossible case to present to a jury and once a jury gets the case, a particular jury could decide to convict or not convict.
