In respect of Aaron's Revenge Porn charges, would the Prosecution file charges if they had not already obtained a copy of the photo that Aaron sent Geno, from either Aaron or Geno's phone service provider?

I get why they would want a witness to also confirm, but surely this case would not have been filed if Aaron or Geno could simply lie their way out so easily?

Yes. They would. The prosecution's attitude toward the entire case is one of pushing everything right to the limit in term of process and the law. Its no different than charging this case as a felony. For whatever reason, the prosecution has decided to be as aggressive as possible in the case.

They likely believe that they have two witnesses who they can use to verify the contents of the photo and the distribution of the photo.

Aaron as the defendant doesn't really have an opportunity to lie his way out. Geno's attitude all along in the case has been rather unpredictable and inconsistent. The prosecutions belief in Geno as a witness is no more absurd than their belief in Kayla as a victim and a victim so damaged that this case rises to a felony with one image distributed to one person.

And even if Geno is uncooperative as a witness, he can be confronted at trial with his inconsistent statements in front of the jury. Maybe they spin that at trial in the prosecution's favor at trial....or maybe not.

The motives and reasoning of the prosecutors in the case is unknown. Its an odd case to prosecute for many reasons. But they could either have evidence the public is not aware of or there is some overriding reason they have for going so aggressively after Aaron. Its possible to speculate a long list of potential reasons, but we are unlikely to know much of anything until the trial.

Well, it seems pretty clear to me why they are pushing it: the dude is a complete asshole towards women and the CA is a strong women´s and victims rights advocate. For why they are prosecuting the felony, I´d bet my house Aaron´s team taught they had something substantial (to their case) regarding the hacking - which they obviously didnt - and probably tried to push for a way more favorable deal than what they were offered for a crime, for ridiculously broad the law is, he undoubtedly committed.

ETA: for funny that it is for us, there was absolutely no need for Aaron to go on his cuck tour exposing snow angels and naked Twister stories about the qover. He wasn´t under any legal scrutiny at the time or slander from Niggieta´s camp that demanded him to defend himself "exposing the TRUF". He did it because he is a fame whore and for the superberries. That might not have gone well with the prosecution as well after Nick probably told them all about it.

Aaron may not seem that objectively bad in the grand scheme of things but he has a history and a positive talent for inspiring hatred of himself. While it's not illegal to be a misogynistic dick, he's gotten away with some incredibly stupid criminal conduct. It's minor but persistent. It could seriously just be an example of them having had it with his shit.

I still wouldn't be surprised to see it settle up to and including literally minutes before the jury is empaneled.

There are a few things in the appearance on Melton's show worth discussing further (or not - this thread is understandably tired about rehashing certain subjects).

Nick said that the bullet of coke on top of the bedside table (the mini-fridge that Aaron bought Kayla for snacks) was unaccounted for in the discovery evidence despite being on the bodycam. (He was implying that the cops snorted it - whatever.)

I have questions/comments.
  • Was this coke NOT counted in the weighing of the coke for the felony charge? If so, there was MORE than 25g of coke in which he pleaded due to maybe-Ziplocs.
  • Nick's whippet-moddled brain admitted that there was cocaine NOT in the safe. He has simultaneously claimed his coke was always under lock and key when saying his kid could have never gotten into it.
Starting at 1:08:12:
New Zealander asks if they took the safe and if Nick has it.

Nick: I do not have the safe uh but it is not on their inventory list. I don't really know where it is at the moment. Uh, two ounces from the top of the fridge did disappear. It's gone. The bullet was, they said, the bullet on the nightstand that was on top of the fridge all right with April's credit card, yeah, that cocaine. I'm I'm I'm not joking. It's not in Discovery anywhere.

I got the pictures of all of the all of the recovered stuff and that exhibit. There is no cocaine. There's no cocaine associated with that bullet. It's nowhere to be found. It's amazing like there there's allegedly 2 oz. of cocaine and that thing and uh and it just it just vanished like maybe up a nose or two.

So, to be very clear here.

He admitted that the bullet coke was NOT in the safe based on the body cam and that there is MORE than may have been accounted for. He has also admitted that 2 ounces of coke in a bullet was out in the open for any wondering kid to find.
