There are two defendants in the case (Jersh and Lolcow LLC). " _s' " is the correct way to write the possessive form for words ending in "s"; One defendant's, two defendants'. Most commonly occurs for plurals, but also applies to singular nouns which end in s (Russ', Skordas', the class', etc.)

Greer is the Plaintiff, not the Defendant. Hardin used the wrong word entirely.

i'm honestly surprised the legal kiwis haven't made a thread about it. i know it's a lot of work but it's fascinating.
The problem now is there is so much assbaggery that's gone on, it could take weeks. The fact that they are still getting discovery from the first trial, that the prosecution has determined whether it's exculpatory or not, and the judge's excuse that 'this is a new trial' is fascinating. Would there even be a 'new trial' if the defense had gotten all it's supposed to get?

I choose to believe this is Hardin throwing some shade at the court for allowing the retard to smear shit all over their walls with little to no consequences.
hardin really took the gloves off this time. let us hope this strategery was the right one (it HAS to be the right one - if not, judges are complete jokes).
I mean at this point he has no choice but to push back at the judge. I mean look, usually this is a bad idea but Greer has been such a vexatious litigant and the court has been so weak on the matter that you need to remind the judge just how much he is letting Greer get away with. Hopefully it doesn't blow up in Hardin's face but I don't think it will blow up.
 
I know nothing of this., Where can I find a decent overview that will get me up to speed, and where can I find good coverage?
In addition to what @Iron Hamster mentioned, @Potentially Criminal covered the first trial and has been covering all the updates in the meantime if you want to support a kiwi. Looks like no playlist for the trial but here's the first day. I assume he covered some pre-trial stuff as well but I didn't keep up with any of that, I jumped into the trial once it was already well underway after hearing about how insane everything was

I don't think it'll blow up into actual trouble, Greer has been too blatant. But I do think it gives ammo to a judge who wants to find a "both sides are obnoxious" excuse to yell at everyone in sight. Whether or not the judge is at that point is a judgement call Hardin has to make, balancing his necessary defenses with further attacks on Greer's case and antics. That's part of the job in any suit, even non-retarded lolsuits.

My outsider, tea leaf reading, useless speculation is that the Magistrate judge is closer to slapping Russ in necessary ways, while the District judge is closer to disliking both sides. The Magistrate sees all the details of Greer screwing around with discovery, the District just sees a garbage suit that keeps popping up. The $1k fee ruling is the sign of someone not willing to figure out what's going on, he just wants everyone to get on with it. The Magistrate is the one who had to issue orders to Russ (and only Russ) to get things moving.

Unless I'm missing something, this particular thread of orders and motions is wholly before the Magistrate, so maybe that's better for this kind of response. Then again, counting on any level of the Court to clean up Greer's garbage like they should, is a sure path to disappointment.

Didn't know he was doing daily coverage. I listened to Melanie Little during the trial as I couldn't find anyone I would normally follow at the beginning and didn't want to miss anything.
 
Maybe I missed it, but I wonder why Hardin hasn't brought up Russ constantly trying (and failing) to intervene in other cases as the defendant. If Russ is just so busy that it is so hard to respond in a timely fashion to discovery requests and court-ordered actions, why is he spending time and energy in trying to get involved with other lawsuits?

Most adults eventually catch on to the "so busy" excuse, whether it is a parent with a teenager and uncleaned room, a teacher with a student and homework, or a boss with a subordinate and an assigned task. Ask, "Doing what?" in response to them being "so busy", and watch the obvious lies start.

I didn't realize I hadn't made a playlist! Fixed it for trial v1.0 and v2.0

He has, at least with that one Doe v. Lombardo case were were talking about recently:

Hardin brought this up in ECF 239 as part of his most recent request for sanctions and included the Doe v. Lombardo thing as an exhibit. I hope he's aware of all the other occasions, and I hope he can work it into his response to the Amended Complaint somehow.

The court probably won't care unless they he can show Russ was submitting motions in other cases close to or overlapping with deadlines he missed. I don't know of any that have lined up nice and neat with this case's deadlines, but I only briefly looked.

Significantly, Hardin can't make that argument fully, because Russ hasn't provided a full list of all litigation he's been in, much less all the related documents. Hardin (and us) has had to do the research himself, even though he has a valid discovery request open for that list. The judge even explicitly allowed Hardin to ask for those documents during the scheduling conference.
