The author of that article said that the offense is a state jail felony and that it carries a minimum of 5 years in prison. That is wrong. The penalty for a state jail felony is 180 days to 2 years in jail. I found this on Google in less than a minute: search "state jail felony texas". He couldn't even be fucked to do that.

In the article they said Goblin Slayer would be banned. But in the law in the definition of Obscenity which itself cites, under Section 43.21 (a) (1) (b), Obscenity only applies if the work lacks serious literary, artistic, political, and scientific value. In other words PORN.

We already had a supreme court ruling on this exact question, only a decade or so ago. The 8-1 answer was no, without a victim you do not have CP, or a crime. Even 100% life like CG. As nauseating as that sounds, it was unquestionably the correct call. It really is a nightmare scenario but the reality of laws and freedom. Just like with guns and shootings.. the price of freedom.
