Yeah allegedly Destiny has done this type of thing to a lot of women, but the percentage that have decided to do something about it is very low.
I’d bet a million dollars Destiny ran his stream much like the old casting couch of yore, with just a tad more finesse. I’m sure they agreed they were open minded, sexually adventurous, not prudes!, because ofc those are the types of people he really admires and are a good fit for his stream. There are few people in the streaming world that don’t give pervert or creep vibes. Only certain types of people seek this type of attention and audience or “entertainment careers” in general. People seem to think they go after young people because of attractiveness, but it’s usually because they are naive, over eager and more easily awed, bullied and manipulated.

From what I can understand, the reason why Destiny decided to not shut his mouth and let his lawyers handle it. Is because he doesn't want to wait for the legal proceedings to play out (they won't play out in his favor anyway) So it's better for him to do full-on narrative control, so even if he loses the case, he'll make sure that his audience will remain unaware.

He might just not even have a lot of faith in this case.
 
My money is on settlement before that starts. Destiny is guilty as sin and the fastest win win for everyone involved is a confidential settlement and non disclosure agreement.
If the 15 million dollar demand to settle from pxie is legit, then there is really no point in settlement.

That also might explain why Destiny isn't even bothering with the usual fights over Jurisdiction and Procedure. From the sound of things Pxie's lawyers are working on condition where they will get a cut of any settlement and are not billing hourly. So any delays will not cost her anything, while costing Destiny a shit ton of cash. Likewise, if her demands are extortionate then there is no point in even trying to settle. 15 million dollars for what is alleged is frankly ridiculous and if that does turn out to be true my opinion of Pxie has cratered.

And I would imagine it would be a similar reaction once a Jury got the case. So the fact Destiny chose to avoid the usual procedural shenanigans and seems to be moving things foreword expeditiously say's to me the strategy is to get this before the court as fast as possible. Maybe they can find some way to torpedo the case in Discovery, but barring that just take it to trial. Whatever she ends up with at the end will be WAAAAAAAAY less then 15 million dollars. The goal of the trial is to make the plaintiff whole if they prevail. How much is Pxie's damage from this actually worth? Sure there is some damage, but 15 million dollars worth? Unlikely.
 
Tiny is in trouble. I think he should call some large bankers or someone from the democratic party. I am sure they will bail him out for being so much if a status quo lapdog by bailing him out of potential responsibilities.

100% disagree. If Tiny's defense conforms to what was said in his Answer, there's gonna be plenty of fireworks trying to shift all blame onto Pxie before any settlement. If Tiny ever agrees to settle, right now he is dug in deep, but that kind of thing can change very quickly to our perspective that isn't seeing anything going on behind the scenes

I can't account for why Destiny's attorneys chose not to move to dismiss the complaint at the outset, but I'd be shocked if they actually want to go to trial. Don't forget, Pxie is also seeking punitive damages, which is more about punishing Destiny than it is about compensating Pxie. I suspect there will be a fight over subject-matter jurisdiction and whether the federal statute even applies given the timing of the leaks; Destiny has other avenues to raise that issue other than in a motion to dismiss.

Punitive damages are not necessarily something that can be applied, and even then the punishment must fit. What has been alleged is not that Destiny shouted to the high heavens to come and look at this revenge porn. Its that it was shared with one person, and then that one person decided to share it with everyone. Pxie has a big problem in that she has not made the leaker of the tape herself a codefendant. Now, this is certainly in the interests of her judicial economy, but imo it's a critical error and one Destiny's lawyers are actually exploiting to thread the needle.

This is the thing. Destiny didn't spread this shit around the internet. A random fan he shared the tape with did. Now, Pxie could argue there was a conspiracy between Destiny and this person and they were acting in tandem. Thus, the spread of the tape was coordinated. But Pxie is not alleging this. She is alleging sole responsibility by Destiny. Which means a critical link in the damage will remain unresolved.

I think Destiny's lawyers realize this. They will argue that yes their client fucked up. But he only shared the video with one person. The actual monetary damage for their client can only realized based on the record. That destiny unlawfully made a recording, and shared it with one person. Everything that happened after that was not his fault or liability. Their client should thus pay statutory damages if they entail, and restorative damages for one viewing of revenge porn for 10,000 dollars. The Jury or Judge may disagree and say that nooooo, he must pay 100,000 dollars!

Either way Destiny wins. Pxie has fucked up at the start from what I am seeing, and its being exploited hard. Sometimes the best defense is not fighting at the border. It is surrendering ground and drawing the enemy in for a single decisive battle. Which it seems to me won't be about whether Destiny did the thing. It will be about just how much he owes for doing the thing. Speed running the case without objection all the way to judgement will cost Destiny little money, and at the end Pxie may find she won't get much either because she very critically left out an important factor that would determine her damages.

I don't necessarily believe she'll be able to substantiate this particular claim, especially since she claims to have only found out months later and during a period in which Destiny was supposedly deleting messages, but it's worth noting that Destiny was allegedly sharing it to far more than one Discord kitten.

Pxie’s lawyers could have initiated the case when they wanted to, If they needed more time to gather evidence, they could have waited.

They also can ask for delay extensions if they need more time.

Realistically, Pxie is the one with less ressources and Destiny is the one who would benefit in extending the case as soon as possible if he can’t get it dismissed.

The allegation they are making isn't that there was a conspiracy. Pxie alleged in her initial statement that Destiny himself might have been the one to leak the video to (Kiwifarms) and pretended it was Rose/Solo who did it but her lawsuit makes no such claim. There is no claim that the leaks came from multiple places or from multiple people.

The lawsuit is about him sending it to Rose without consent. Supporting evidence for him sending videos without consent is the (to be proven in court) fact that he sent the video to multiple people, showing a disregard for Pxie's privacy and wellbeing. By sending it to multiple people, let alone one person, that increases the potential that Pxie's privacy (etc) would be violated because Destiny was not sharing these with people he could presume to have confidence in: he was sending them to randoms. Destiny had no way to gauge the privacy of those person's devices and who could have access to that content through the person he was sending it to directly. The maliciousness of this act may be hard to prove but at minimum it was negligent.

There's also the interesting bit that Destiny stored his sex library on Google drive with the privacy settings set to "public."
