Not to get into the weeds but it really only benefits those who make tips through electronic methods. The vast majority of people aren't recording cash tips on their taxes anyways. And the only difference is that the "taxable" income off a W-2 wouldn't include the tip amount.So, not applicable to him at all because the things he calls "tips" really aren't what the law is talking about.
Phil gets a 1099-K which does not even have a section for that. In classic US form, you'd probably have to prove some of that income is "tips" but Phil would be a moron to try that for all "tips".
