The UK never ceases to amaze me on how stupid they are when it comes to everything. They had a golden opportunity to re-negotiate better conditions and re-establish themsleves as a global player in trade with Brexit, they fucked it up. The Tories had a golden opportunity with COVID to take a public hard line stance (pull a Thatcher) and use that as a chance to consolidate and keep in power for another couple of terms, they fucked it up. Starmer's Labor party has a chance to ease restrictions on a lot of issues and rebuild UK industry, and can pretty much coast on those two things alone, and here they are yet again fucking up.

It seems to just be demanding you carry out a "risk assessment", then keep the results on hand. Their four-step process isn't even binding, they're using it as a suggestion while saying "there is no one-size-fits-all approach".

The clever bureaucrats know someone might submit a 1-sentence assessment that says "no risk at all", so they stretched their IQ to come up with some standards:

Your risk assessment must be suitable and sufficient, which we explain in more detail in the section ‘What is a ‘suitable and sufficient’ risk assessment?’

"Assess the risk", "take into account", "Consider" x3. This could probably be pawned off by asserting "low" for all 17 categories, then pointing out KF tracks zero user or profile data beyond email address. That's not a suggestion to Null, I'm just remarking how toothless this report is designed.

The gotcha trap seems to be from demanding an ooperator consider all "relevant information and evidence". The guidance here is vague enough that a hostile bureaucrat could accuse anyone they hate of failing to meet evidentiary standards, somehow.





And if you just can't figure out enough reported risk to keep the harpies happy, have some consultants manufacture it for you.

The other trap is in requiring you to re-do the assessment any time you make "a significant change".



It is not coincidental that this part is called out as a specific legal duty. It's vague enough to let a bureaucrat designate any change as needing a requirement, and penalizing anyone they can accuse of having insufficient paperwork records.

I suspect this is designed to be the continuing stick held over the head of sites that previously complied, but fall out of favor with the regulators. Even good-faith compliance won't be enough, as the regulators demand a new report after every feature is added, and spend months arguing and accusing of it being insufficient each time. The process is the punishment.

There's likely other dumb laws hanging around to address the actual illegal stuff, but this particular act seems entirely pointless against illegal content itself. It doesn't require sites to remove or block content, just to think about it and keep tons of paperwork. The biggest trap seems to be letting regulators bury sites in reporting demands, with no recourse for site owners to fight their declarations that the reports are "insufficient".

Their enforcement site says "We have strong enforcement powers at our disposal, including being able to issue fines of up to 10% of turnover or £18m – whichever is greater – or to apply to a court to block a site in the UK in the most serious cases." They are threatening this "if any platform does not provide us with a satisfactory response by the deadline". So they aren't planning to fight the naughty sites over the content--but over bureaucratic compliance with glorified TPS reports. It's the gayest way possible to do censorship.
