According to him, he had even confronted the board of directors about the misconduct before Karl and Mutahar started looking into it, and the board clearly didn't give him a good explanation. Apply that same standard to Jirard, did he lie when he condemned his family's charity fraud, or did he lie when he said he did nothing wrong.

Yes, question is if he can defend on appeal using another defense than he used in the actual trial.
Because the lawyer forgot to plead the correct defense.

They did not even try to argue the statements were factually true and/or Karl had a good faith source for the information.
The judge cannot consider something the defense did not plead, so some of the information was simply accepted as fact by the judge because it was never contested by Karl's lawyers in the first place.

If anything he should appeal on grounds of ineffective defense because his lawyer not only forgot to make the right pleadings, he also fucked up in the closing arguments misrepresenting the timeline of when Karl uploaded and corrected the initial video. (According to the handwritten notes of ErsatzCat who watched the stream of the closing arguments the lawyer had to correct his blunder AFTER the closing argument was already finished)


If you look at the this entire case as: "Karl claims Billy contributed and/or caused the suicide of ApolloLegend", Billy claims that is defamatory because it is false. Why the fuck was it not contested in court if the claim was factual accurate? The "he received a big sum of money" could have been argued away as receiving false information from someone, but if you do not even contest that the claim made by Karl was false, how can he not lose the case?

Billy wins because Karl's lawyer failed to defend against the actual defamatory statement, so it was accepted as fact.

Of course, but it was a pretty firm and clear judgement. It might not be worth the money to fight it.
An appeal should really focus on reducing the payout, on the basis that Karl's slander didn't actually affect Billy financially, it's not like the suicide allegations caused a boycott of Billy's restaurants or got him banned from events, or Billy was diagnosed with depression / anxiety because of it which prevented him for working. In the USA anyway, proving the defamation caused financial harm is how you get a judgement to provide financial restitution. Realistically, Billy's only costs here were his court costs, and depending on how reasonable those ended up being he could probably argue against paying all of that too.

... but Aussie courts may just believe hurt feelings are worth half a million + and Karl is totally fucked in this case.

I watched all this go down in real time and I just want to state that I too thought the lawsuit was about the cheating allegations. Carl absolutely lied by omission and regardless of whether you're hypermoralistic or not that leaves a bad taste in everyone's mouth.

It's one of those behaviors that's so inherently manipulative that it's an enormous red flag for basically anyone with any understanding of these fucking creeps. Anyone that's willing to twist a story like that is also willing to do basically anything that they would get called out that's immoral so long as they can get away with it. It's basically a dead giveaway for sociopaths and people with antisocial personality disorder.

I think everybody involved with this story needs to die in a chemical fire minus Whitegoose. In my opinion Billy Mitchell absolutely contributed to some dumbass speedrunner killing himself by trying to sue him for daring to say that he cheated, which is autistic as fuck in and of itself bc Billy is just doing the scientology schtick of suing ppl into silence. Speedrunning itself is fading into obscurity minus the niche where it exists on twitch and YouTube. Like multiple people have said the thread so far: we really should have been focusing more on the side of this lawsuit that was full of the degenerates and trannies.
