Sentencing isn't negotiated. Its almost entirely up to the judge within the limits of the sentencing guidelines. Judges are unpredictable. But what this PSIR does is give the judge a clear path to giving him exactly the recommended sentence. The PSIR justifies at least doing that. The PSIR was harsher than I was expecting.

But what happens now is really up to the judge.

Pretty much. I posted both the feds and the defendant's ones in the Jeremy DeWitte thread when he was being jailed for lying to the IRS, if you want a fun example. The feds went all out with a 24 page meticulous breakdown of his long history of criminality and lying to basically everyone about everything and asking for the maximum of 51 months. The defence responded with a weakass 6 page response asking for them to show mercy on account of him being a retard and shit, with a sentence of no more than 33months. Eventually the judge basically went down the middle at 41 months.
