That said, depending on your offense the court can make you serve the full 5 years. In some cases the courts can also just extend your probation.

sure, you can technically buy and use more Adderall for example if it’s prescribed to you but if you’re on probation drug testing they will likely be measuring the levels of prescribed drug in his system. No, the net 28 days in jail (not prison) is an adjudicated part of his sentence that is stayed at the discretion of the judge. Theoretically the judge could hang this over Nick as another Sword of Damocles. The prevailing theory is that it will be dismissed if he is behaved until August.
