Illegal was in court that day for an unspecified, presumably unrelated matter. ICE Presents themselves to the various courthouse officials, has a warrant, all that jazz. Take up position in the hallway outside the courtroom after agreeing with the court to wait until after the illegal had his case heard. Judge Dugan learns that ICE is here, comes out, demands ICE follows off to talk to a senior judge, one agent stays behind only because the judge didn't realize he was also ICE. Dugan returns to her courtroom .
While ICE speaks with the senior judge via phone in a private room, the court day continues. The testimony recorded here is a bit muddled, but as far as I can tell, the court docket goes on as expected, until they reach the 'end', at which point an attorney notices that the Illegals case has been skipped, and asks what's up with his clients case, as he was the public defender for the illegal. The judge informs him the case has been Adjourned, so delayed (which is extremely unusual as a unilateral declaration when everyone in the room is present and ready to present, my personal comment) for now. Multiple witnesses then corroborate the Judge taking the Illegal and an attorney personally out through the Jury Exit, after stopping them from leaving through the public exit that the one ICE Agent was still waiting at.
Once the Illegal is out through this alternative exit, the Illegal and the Attorney are spotted by another agent moving to a distant elevator seemingly chosen deliberately as the most likely to not be watched, away from the Courtroom and exiting the building. ICE is notified of this, and scrambles to find the now escaping illegal. They spot him outside the courthouse, they move to arrest, he books it and runs, and is arrested shortly after.
Effectively, Dugan appears to have deliberately redirected ICE Agents away from the Illegal, and then facilitated the escape of an illegal with full knowledge of a valid warrant and arrest procedure underway, via court privileged access of private areas that ICE complied with requests to not touch.
