The International Emergency Economic Powers Act, from my understanding, applies to articles imported which is normally interpreted as physical goods rather than media. I’m not sure he’d be able to issue tariffs on movies without court challenges regarding constitutional violations.

I don't actually expect this to affect productions much, the way companies have historically dealt with this is to have some remote work monkey work as "consultant" in some advantageous american position (the company I work for does the same to claim tax benefits).

Remains to be seen though.

The authority granted to the President by this section does not include the authority to regulate or prohibit, directly or indirectly, the importation from any country, or the exportation to any country, whether commercial or otherwise, regardless of format or medium of transmission, of any information or informational materials, including but not limited to, publications, films, posters, phonograph records, photographs, microfilms, microfiche, tapes, compact disks, CD ROMs, artworks, and news wire feeds. The exports exempted from regulation or prohibition by this paragraph do not include those which are otherwise controlled for export under section 4604[1] of this title, or under section 4605[1] of this title to the extent that such controls promote the nonproliferation or antiterrorism policies of the United States, or with respect to which acts are prohibited by chapter 37 of title 18.

And the Berman Amendment in general from the 80s that was clarified in the Free Trade in Ideas Act in 1994.


In 1988, Congress passed amendments to the TWEA and IEEPA, authored by Rep. Howard Berman (D–CA), aimed at protecting the rights of American citizens to receive information, regardless of the country of origin of such materials used, by exempting varied methods of communication from regulation. The revisions to both acts, known collectively as the "Berman Amendment," restrict the President's authority to regulate or prohibit the importation or exportation of various forms of print, audio and video materials, artwork and other images, and other informational materials protected under the First Amendment.[15] The Office of Foreign Assets Control (OFAC) under the U.S. Department of Treasury, however, interpreted this exemption narrowly to claim it held the right to prohibit any transactions associated with "informational materials not fully created and in existence at the date of the transaction."[16] In response, the Berman-sponsored Free Trade in Ideas Act—passed by Congress in 1994—revised the original amendment's First Amendment exemptions to include newer and forthcoming mediums (including intangible items such as television broadcasts and methods of personal communication), further clarifying that the President's emergency sanction powers under the IEEPA and TWEA cannot be used with regard to any information or informational materials, regardless of their format or medium, or whether they are intended for personal or commercial use. The updated language also clarified that the non-exhaustive list of exempted materials was illustrative in nature, inferring that unlisted materials not yet invented or in wide use at the time of its passage would be prohibited from being subject to sanctions or other regulation under both acts.[17]

So I'm really skeptical he'd be able to even enact the tariff or if one would be upheld if challenged in court.
 
I’ve come to realize it’s basically futile arguing with someone in favor of Trump’s economic plan. These people are not really interested in seeing things get better, they just want to feel like they’re winning.

A tariff on films is also a tariff on creativity. It limits the kinds of movies that can be made without running afoul of tariffs.

Shooting locations aren't only chosen based on financial incentives. A film set in contemporary America would be safe. However, if you wanted to make a movie set during the Slovak National Uprising or Operation Storm, you would naturally film in Slovakia or Croatia, where these events actually took place, only to then be punished for doing so.

On a semi-related note, they had the White House twitter account tweet out a copy of the constitution, I suppose to help establish that they know it exists after complaints that Trump was against saying he'd uphold it.

Nintendo raising their prices on games wasn't due to the tariffs, only peripherals went up in price due to the tariffs. They are just very greedy.
Greed is indistinguishable from standard business practices. Tariffs are passed over to the end customer based on the business's discretion. Either the company pays for it themselves or they pass the cost to the customer. Nintendo is going for the latter whether it's factually true or not because now they can shift the blame to America instead of taking it themselves.
