I'm not a lawyer, but I'm pretty sure that the SCOTUS case Castle Rock v. Gonzales set the precedent that police departments aren't obligated to protect individual members of the public from harm; In addition, prosecutors have "prosecutorial discretion", which means they aren't actually obligated to charge people if they don't wish.
